The judges of the SCM give the judicial inspection on the magistrate who suspended the decision to cancel the elections

The Section for Judges of the Superior Council of Magistracy (CSM) decided to notify the Judicial Inspection with a possible disciplinary deviation in the case of the magistrate who suspended the decision to cancel the elections. The reason underlying the referral is that in 30 other similar situations the solution was to reject the suspension of the Constitutional Court (CCR) decision.

“In relation to the public interest manifested in relation to the solution given by the Ploiești Court of Appeal during today, April 24, 2025, the CSM judge section decided to notify the Judicial Inspection in order to carry out a possible disciplinary deviation by the judge who resolved the case.
The measure will take into account the fact that in about 30 other identical causes solved by the courts of appeal in the country the solutions were to reject the action, the judicial practice being unitary in this regard ”is shown in the statement sent by the SCM.
We recall that on Thursday, April 24, a judge from the Ploiești Court of Appeal accepted the appeal regarding the suspension of the decision of the Constitutional Court (CCR) to annul the presidential elections taken on December 6, 2024.
Subsequently, the Prosecutor's Office attached to the Ploieşti Court of Appeal declared an appeal against the court of the court.

According to the decision published on the portal of the Ministry of Justice, the decision is not final, and the CCR has the right of appeal in 5 days after the ruling.

Suspends the execution of the Constitutional Court Decision no. 32 of December 6, 2024, until the definitive settlement of the case. Admits the action for annulment. Annul the Decision of the Constitutional Court no. 32 of December 6, 2024. Obliges the defendant to pay the costs to the applicant in the amount of 70 lei, representing judicial stamp duty. With the right of appeal within 5 days from the ruling. The request for appeal is submitted to the Ploieşti Court of Appeal. Pronounced by making the solution available to the parties by mediating the court graft today, 24.04.2025”, The statement said.
