The first US state to sue the US government because of the “illegal tariffs of President Trump”

The US state of California is about to act in the US government on Wednesday, challenging President Donald Trump's authority to use emergency powers to introduce customs tariffs against Mexico, China and Canada, a statement issued by the representatives of Democrat Governor Gavin Newsom, according to Bloomberg shows.
The trial filed by Newsom, announced on Wednesday morning with the California Attorney General, is the first appeal made by an American state against Trump's rates, a measure for the current president's policy, notes Polito.
California, the fifth largest economy in the world, risks losing billions of dollars due to customs duties, given that the major state industries, from Silicon Valley and to agriculture, depend to a large extent on global trade.
“President Trump's illegal customs tariffs cause chaos on our families, business and economy in California – increasing prices and threatening jobs,” said governor Gavin Newsom. “We defend American families who cannot allow their chaos to continue,” the Democrat official added.
Newsom's process is also the most direct legal attack on Trump's agenda after the Republican's return to the White House. The action reappeared instantly disputed between California and president and strengthens the state's position at the top of the resistance.
The appeal is also noted as a unilateral action, which highlights the specific importance of the problem for California. The Attorney General of the State, General Rob Bontta, had collaborated closely with other states led by Democrats in processes regarding Trump's policies in terms of immigration and reduction of federal expenses.
The spokesman of the White House, Kush Desai, accused Gavin Newsom, on Wednesday, in a statement for Politico, that instead of focusing on California's issues “he spends his time trying to block President Trump's historical efforts to approach the national emergency of our country.”
The process filed by California is targeting IEEPA
Newsom and Bota's argument refers to the Emergency Emergency Powers (IEPA), the law that Trump uses to introduce rates without approval of the US Congress. The two Democrats claim that the Republican president does not have the authority to implement such taxes under the respective law, a position expressed by a group of American companies in a process initiated on Monday.
Donald Trump is the first US president to impose rates by this norm, which allows the president to regulate foreign financial and assets when there are emergency circumstances. He defended his method by claiming that the commercial deficits that the US has with other countries represent a “national emergency”.
“The entire Trump administration maintains its commitment to approach this national emergency that decimates the American industries and leaves behind our workers, with every tool we have available, from customs tariffs to negotiations,” Kush Desai said after the announcement of the Governor Californian.
The California General Prosecutor says about the large -scale economic consequences caused by Trump's approach to represent “almost daily threats”, which exceed the limits that the law provides for the presidential powers.
“The chaotic and random implementation of customs tariffs by the president is not only deeply worrying, but it is also illegal,” said Bontta.
A week ago, US President Donald Trump had a 90 -day break in applying “mutual” customs tariffs he had announced for imports from dozens of countries, but the break is not valid for China. In addition, a 10% universal tariff will be maintained for all commercial partners.
