No party can use antenna times in favor of another candidate than the initial registered one, says the CNA, citing the BEC decision according to which “as long as the USR party has an electoral competition, in the first round of the poll, this political formation cannot make an election campaign of any other candidate who participates in the same electoral process”.

According to a press release of the CNA sent on Tuesday and quoted by Agerpres, in the audiovisual space, according to the provisions of art. 4 para. (1) of the CNA decision no. 86/2025, the candidates had available March 24-April 3, 2025 to address in writing to private radio and television stations that announced their intention to make the electoral shows, requesting the antenna times to use.

“We emphasize that the law stipulates that, in the election campaign, all candidates must benefit from a fair treatment in terms of the time allocated on radio and television stations, namely the distribution of antenna for access is done equally. Thus, in the case of electoral promotion and advertising spots, only an electoral time, Candidate.

On the other hand, the CNA shows, taking into account the fact that in the case of the electoral debate shows they benefit from an emission space and considering the allocation of antenna times for the electoral promotion shows and for the electoral advertising spots, the support of a different candidate than the one on the validation of the candidates is a violation of the provisions of the CNA no. 86/2025, which is adopted within and for the implementation of the electoral legislation.

CNA: “By supporting another candidate after the candidates are finalized, USR would make a new proposal, which is inadmissible”

“First of all, the antenna times are allocated for candidates, equally and free. The access of candidates to the services of public and private radio and television programs is free, and the private programs services will provide the candidates to proportional to those practiced by the services of public programs. The political parties, the political alliances, the aliability and the organizations of the citizens. He participates in the elections benefit from antenna times, in the private radio and television services, for a fee. Electoral campaign of any kind to another candidate participating in the same electoral process', “explains the CNA.

In the given context, the CNA specifies that it monitors the respect for the equity regarding the distribution according to the legal provisions of the antenna times by the broadcasters for each individual candidate, through the officially validated candidates.

“For the litigious situations regarding the allocation of antenna times, the programs services will have to prove that they have provided the candidates with the antenna times, under the conditions provided in Art. 40 paragraph (2) of Law no. 370/2004”, the CNA statement said.

The CNA reminds that the BEC stated that “as long as the USR party has a candidate participating in the electoral competition, in the first round of election, this political formation cannot do an election campaign of any kind to another candidate in the same electoral process.” This is where it represents a violation of the legal provisions provided in art. 36 para. (7) of Law no. 334/2006 regarding the financing of the activity of the political parties and the electoral campaigns, republished, with the subsequent modifications and completions, by the support granted by the USR party after the expiration of the finalization date of another candidate than the initially proposed, in fact, in favor of the independent candidate Dan Nicuşor-Daniel, with the extent of the legal provisions. The period of applying for the candidates, which is inadmissible, shows the CNA.
