The reaction of the Central Electoral Bureau (BEC) comes shortly after requesting the deletion of some Facebook posts by former judge Cristi Dănileț. BEC motivated that the messages published by it represents “Political advertising materials”, and Danileț is “a political actor ”.

In order to correct the public information in relation to the decisions that circumscribe the competence of the bulb, as a relevant authority that may order, by order, that the very high online platforms should act against one or more elements with illegal content, BEC brings a series of clarifications.

According to the quoted source, because the public interest is primarily manifested regarding the removal of materials with illegally posted in the online environment by natural persons who do not have elective functions or other public functions, the bulb specifies that “A correct electoral process implies, among other things, a fair balance between freedom of expression, including the right of a person to have political opinions, and guarantee that the information and messages promoted are confined to the desire to prevent the actions of manipulating and misinforming the voters ”.

“In situations in which natural persons who do not have elective functions or other public functions post on personal accounts, opened on very high online platforms, mainly and repetitive-an aspect found directly and directly by the bulb-electoral propaganda materials, then the natural persons acquire the quality of political actors with the potential for influence, in the task, The respective materials for the purpose of warning and informing the public regarding the character of political advertising material of the posting, the lack of proper labeling qualifying the material as having an illegal content ”, explained the bulb.

At the same time, the representatives of the BEC emphasizes that both the communications that are within the limits of the journalistic activity of information of the public, as well as the public opinions expressed in personal name, in the online environment, by natural persons who are not political actors, “They are essential components of the right to information, respectively of the right to free expression, so that in none of the situations circumscribed to these hypotheses and deduced from the BEC analysis, the measure of removal of the posted materials has been ordered.”
