A certificate of no criminal record will go to the mobitital? Talks of ministries are underway

The Ministry of Digitization is conducting preliminary talks with the Ministry of Justice regarding the possibility of providing a digital certificate in the MOBKTRACTO application, the ministry of digitization informed PAP. The solution will be helpful for parents who want to act as a guardian on school trips.

In August, President Karol Nawrocki vetoed an amendment to the Act on counteracting threats of sexual crime and the protection of minors, which provided that schools would not require parents and guardians a certificate of criminal record with KRK, but only a statement made under pain of criminal liability. In connection with the veto, the existing provisions of the Family and Guardianship Code and some other acts are still in force, i.e. Lex Kamilek.

Working with children after checking the guardian

In accordance with applicable regulations, the institutions in which work is in contact with children must comply with the principles of safe recruitment: check new candidates in the register of sexual offenses and obtain from candidates a certificate of no criminal record from the National Criminal Register (KRK). This means that people before establishing an employment relationship or admission to activities related to upbringing, education, rest, treatment, psychological advice, religious development, sport or the implementation of other interests by minors must submit a certificate of criminal record with KRK.

The Ministry of Justice reminds that the parent – the tutor of the trip acts as a volunteer and is subject to verification of criminal record. The amendment to the regulations was to simplify the participation of parents in school trips, introducing a statement instead of a certificate from KRK, but the solution raised reservations, e.g. the Foundation, we give children the strength and the Ombudsman for Children, and was ultimately vetoed by the president.

Digital certificates of no criminal record for now plan

On September 1, the Minister of Education Barbara Nowacka referred to the matter, who emphasized that a parent who was going on a school trip should have a criminal record certificate.

The Ministry of Digitization informed PAP that “Preliminary talks with the Ministry of Justice are currently underway on the possibility of providing a digital certificate of no criminal record. The ministry pointed out that the information on this matter will be made available when specific decisions are made and the implementation date is set. “

Certificate of no criminal record still in person

The KRK certificate can be obtained by submitting a question form of information about a person personally or by a representative appointed in writing. The proxy should then have an original power of attorney together with confirmation of the payment of stamp duty in the amount of PLN 17. The power of attorney must be signed by the principal, and its original submitted in Polish along with a question.
