A breakthrough sentence for pensioners. ZUS must recalculate the benefits again


The Court of Appeal in Katowice issued a verdict that may prove to be a breakthrough for many Polish pensioners. He upheld the earlier judgment of the court in Bielsko-Biała, which ordered the Social Insurance Institution (ZUS) to re-calculate the retirement of a resident of the province. Silesia. Born in 1954, a woman in July 2009 retired for an early retirement, which is entitled to persons working in “special conditions” [dotyczy to m.in. osób pracujących w warunkach szkodliwych dla zdrowia, a także nauczycieli, żołnierzy zawodowych, dziennikarzy itp.].
When she reached the universal retirement age (in the case of women it is 60), she wanted to retire. Meanwhile, it turned out that it would be lower, because according to the provisions of 2013 it was reduced by the amounts of previously paid pensions.

A resident of the province Silesia felt cheated by the state and decided to report the case to court. She won-the District Court in Bielsko-Biała by judgment of March 25, 2025, ZUS obliged to re-calculate the pension. This was confirmed in June by the Court of Appeal in Katowice – says “Wyborcza”.
The plaintiff's pension will increase after a judgment by PLN 281.13, but the woman intends to also fight to compensate for earlier payments from 2015, which in total can be over 24,000. zloty. However, another court case awaits her.

Expert Dr. Marcin Wojewódka from the Pension Institute advises pensioners who were in a similar situation, demand justice on the part of ZUS.
– Everyone who has a similar situation to people who have just won the trial should take advantage of a similar procedure and demand the payment of overdue money – he says in an interview with “Wyborcza”. It is about pensioners born in 1949-59 (in the case of women) and 1949-54 (in the case of men).
It is possible that soon the problem of pensions underestimated by ZUS will be solved in a different way. As reported by “Wyborcza”, the government has already developed a draft “repair” act and sent it to consultation. It is not known, however, whether he will deal with the problem of equalizing the backlog for previous years.
