A judge said in a ruling by the U.S. District Court in Massachusetts that the visa fee policy violates the federal Administrative Procedure Act and the Constitution.
The judge agreed with the view of a coalition of states that challenged Trump's decision, arguing that it limited their ability to hire workers in public schools, universities and health care systems.
The judge also found that “the use of the $100,000 payment shows that it is a tax” and that Congress did not delegate this power to the executive branch.
Donald Trump's administration announced that it would appeal against this verdict.

What is an H-1B visa?
The H-1B visa was created in 1990 and is widely used by American technology giants to attract highly skilled workers from abroad.
The program allows U.S. employers to apply for government authorization to employ nonimmigrant workers in specialty occupations for up to six years.
