DOCUMENT The limitation of the state pension-salary cumulation will be adopted on Thursday. What the project provides

The spokesperson of the Government, Ioana Nadina Dogioiu, announced on Wednesday that the draft law on the prohibition of pension-salary cumulation in the budget sector will be adopted on Thursday in a new Government meeting. The decision was not taken at Wednesday's meeting due to the lack of an opinion.

“The draft law regarding some measures applicable to civil servants and contractual staff paid from public funds, the pension-salary law will be adopted tomorrow, in a Government meeting”, announced the spokesperson of the Government, Ioana Nadina Dogioiu, in a press conference at the end of the Government meeting.

She specified that the opinion of the Legislative Council was still necessary. “He will come tomorrow morning, at 09.00 – 09.30, after which the draft law will be adopted. So it's just a little delay,” said Dogioiu, quoted by News.ro.

What the project provides

The draft law that was analyzed on Wednesday in the government meeting refers to the cumulation under Article VII, the first two paragraphs of which have the following wording:

“(1) Staff paid from public funds in accordance with the provisions of Law – Framework No. 153/2017 on the remuneration of staff paid from public funds, with subsequent amendments and additions, with the exception of civil servants, as well as the staff of autonomous authorities established by the state, of national companies/companies, of companies in which the state is the sole shareholder or holds a majority stake, of autonomous authorities established by administrative-territorial units, of companies in which the administrative-territorial units are sole shareholders or hold a majority stake, as well as regulatory authorities, who benefit from a pension in payment established on the basis of the pension decision from the public pension system, in accordance with the principle of contribution, the decision on the granting of a service pension or a decision on the granting of a pension in the state military pension system, granted under the conditions provided by the specific legislation, may continue the activity with the annual approval of the authorizing officer of credits/the employer or the competent authority in terms of work/service relations, until reaching the age of 70.

(2) The persons referred to in paragraph (1) beneficiaries of a service pension, respectively a service pension in the state military pension system, can be kept in activity, based on an application, on the condition of expressing the option to remain in activity and the agreement regarding the reduction of the amount of the pension by 85%.”

Thus, the measure will apply only to beneficiaries of special pensions, whose pensions are not calculated exclusively on the principle of contribution.

The provisions do not apply to local elected officials and persons with a prescribed mandate
expressly by the Constitution, during its duration, as well as the teaching staff who provide it
initial and continuous training of magistrates or teaching in military and legal education
superior

In the case of magistrates, there are already provisions that reduce the amount of the pension for judges and prosecutors who also receive a salary.

The Bolojan government discussed on January 21, in the first reading, the draft law which stipulates that employees paid from public funds who have service or military pensions and who will have to accept an 85% cut in their pension if they want to continue working for the state.
