Public anti-corruption council of MOU regarding Defense City: we insist on the need…
The relevant official statement was published on Facebook of the Public Anti-Corruption Council under the Ministry of Defense of Ukraine.
“Defence City, as stated, is a program aimed at introducing a special regime to support Ukrainian defense manufacturers. It consists of four large draft laws, which provide for amendments to the Tax (No. 13420), Customs (No. 13421), Budget (No. 13422), Criminal and Criminal Procedure Codes (No. 13423),” the Public Anticorruption Report reports.
According to the GAR MOU, changes to the legislation have many “buts”:
– in the current version, the document contains norms that actually provide for the complete exemption from criminal liability of persons who committed offenses during the execution of a defense order – even if these violations were proven.
– the model looks like it will work in manual mode with limited access. This creates risks of repeating the practice of the “club of the chosen ones”;
– a separate provision of the draft law stipulates that enterprises that are residents of Diya.City cannot become participants in Defense City. This creates unreasonable barriers for those who have already proven their effectiveness in the production of technological solutions for the front;
– the income tax benefit is provided in such a way that it does not reduce, but, on the contrary, increases the complexity for the payer – both in reporting and in the risks of tax pressure;

“The draft law on changes to the Criminal and Criminal Procedure Codes of Ukraine cannot be put to a vote at all,” the GAR MoU emphasizes.
The public anti-corruption council appeals to the industry and the public: “read the content of the draft laws and submit your suggestions. The success of Defense City depends entirely on how well the rules will be written and how transparently the system will work.”
We will remind you that earlier the head of GAR MOU, a veteran and public figure Yuriy Gudymenko, spoke about changes to the Criminal Code within the framework of Defense City: “The draft law, #13423, is complete hell, with which nothing can be done, except to throw it in the trash together with the authors.”
