Prosecutor Viorel Cerbu, positive opinion of the CSM, unanimously / The voting block continues in the case of Marius Voineag and Alex Florenta

The section for prosecutors of the Superior Council of the Magistracy gave a positive opinion for Ioan Viorel Cerbu, the proposal of the PSD Minister of Justice, Radu Marinescu for the position of chief prosecutor of the DNA. In the case of Marius Voineag, who is running for the position of deputy prosecutor general, and Alex Florența, who is running for the position of deputy head of DIICOT, the CSM postponed the decision for the third time, after the vote was tied again.
Prosecutor Ioan Viorel Cerbu, the current deputy head of DNA, held the interview in front of the Prosecutors' Section of the CSM on Monday afternoon. Considered one of the most experienced prosecutors in the DNA, prosecutor Cerbu was voted unanimously by the CSM prosecutors.
On Monday, the section for prosecutors resumed voting for the third time also in the case of prosecutors Marius Voineag and Alex Florenta, after there was a tie in the two previous meetings.
The situation was repeated on Monday, when the voting situation was three in favour, three in favour. Practically, two of the CSM prosecutors voted positively, the third vote being that of the Minister of Justice.
The equality of votes, in the case of prosecutors Marius Voineag and Alex Florenta, is unprecedented.
The CSM regulation has no provisions for such situations, so the vote will resume during the 30 days, the deadline until which the forum can communicate the opinion, sources from the CSM told HotNews.
“If the situation of equality is maintained within the 30-day period, the Ministry of Justice could assimilate voting parity with the lack of advisory opinion and send the proposals to the president without this opinion”, explained CSM sources.
On Tuesday, the series of interviews at the CSM will end with the two prosecutors proposed for the position of deputy head of DNA: Marinela Mincă and Marius Ionel Ștefan.

So far, out of five candidates heard at the CSM, only Codrin Horatiu Miron managed to obtain a favorable opinion for the position of head of the Directorate for the Investigation of Organized Crime and Terrorism.
Instead, Cristina Chiriac – proposed for the position of general prosecutor and Gill-Julien Grigore-Iacobici – for deputy chief prosecutor of DIICOT received a negative opinion, and Alex Florența and Marius Voineag – ballot.
According to the law, the Section for Prosecutors of the CSM issues a reasoned advisory opinion, after which the proposals made by the Minister of Justice, Radu Marinescu, are submitted to the President Nicusor Dan.
In the case of issuing a negative opinion of the Section for Prosecutors of the CSM, the Minister of Justice organizes a new interview exclusively with the candidate who received a negative opinion. Following this interview, the Minister of Justice can continue the procedure by sending the proposal for appointment to the leadership position to the President of Romania or withdraw the proposal, triggering a new selection procedure in a maximum of 60 days.
The President of Romania can refuse, with reasons, the appointment to management positions, making the reasons for the refusal known to the public. The president's decree of appointment or his reasoned refusal is issued within a maximum of 60 days from the date of transmission of the proposal by the Minister of Justice.
