SCT in Krakow. The court declared some provisions of the resolution invalid

The Provincial Administrative Court in Kraków partially accepted the complaint of the Małopolska Voivode and declared individual provisions on the clean transport zone (SCT) invalid. The judgment is invalid.


In addition to the Małopolska Voivode, complaints against the councilors' resolution were also submitted by the Skawina commune and two private persons, including Andrzej Adamczyk, MP, and Bartłomiej Krzych, city councilor from Wieliczka. The court rejected these complaints.
What did the court decide?
In the complaint, the Małopolska Voivode, as the supervisory authority, raised several allegations, mainly: violation of the principle of equality and proportionality before the law. His reservations were raised, among others, by: a mechanism introducing fees for entering the zone for owners of old cars from outside Krakow, while city residents owning the same vehicles were exempt from these costs. He also questioned the area of application of the SCT (approx. 61% of the commune's area) and the provisions regarding the organization of road traffic in the zone, considering them to be too general.
Representatives of the Kraków commune emphasized that by introducing SCT, the city is fulfilling its task of taking care of the interests of residents.
Before Wednesday's hearing, opponents of the zone put up banners in front of the court building: “Zone to be liquidated, councilors to be replaced”, “We will not give up Krakow”, “Hands off our cars”.
The clean transport zone has been in force in Krakow since the beginning of January. The resolution on its establishment was adopted by Krakow councilors in June 2025, and in July the voivode informed about submitting a complaint to the Provincial Administrative Court. (PAP)
