Orban, about magistrates' pensions: “It's embarrassing. If they don't understand, a revision of the Constitution can be done”

Ludovic Orban, presidential adviser, said on Saturday, November 15, that the Executive must urgently adopt the law on special pensions, even by taking responsibility, if the dialogue with the magistrates does not produce results.

“The government must adopt the bill in its final form. At the mediation made by the president in Cotroceni, on Tuesday, they came to an agreement. However, there was an attempt to dialogue with the magistrates, with the High Court of Cassation and Justice, in the hope that they would not attack the Constitutional Court. The position expressed by the representatives of the magistrates is a completely unreasonable position, it cannot be accepted”, declared Orban, during the show “Zona Zero”, from Antena 3.

The presidential advisor emphasized that the position of the magistrates is unacceptable.

“It's embarrassing. I tell you frankly. Magistrates are the ones who must do justice, magistrates are the ones who must take into account the letter and spirit of the Constitution and the laws. Magistrates must understand that they are part of a judicial power, one of the three powers of the state, in which they must, however, take into account public opinion, society. There is absolutely no logical argument.” Orban also said.

As a long-term solution, Ludovic Orban indicated the revision of the Constitution to impose a single pension calculation system, based on contributions.

“And if they don't understand these things, in the end, citizens can be appealed to, a revision of the Constitution can be made in the sense of including a principle that is in accordance with the letter and spirit of the Constitution, namely: all pensions should be calculated only proportionally to the contribution paid by each employee during the active period. And in this way order is made, definitively. Any judge of the Constitutional Court will no longer have a pretext to declare unconstitutional a law that, in practice, abolishes special pensions”, stated Orban, for the cited publication.
