The commune is fighting for the return of overpayments from teachers. The dispute continues
“The teachers were asked by the management and accounting for a voluntary return, because this is how this procedure should be started. Most decided to return” – informed the mayor of Czarna Białostocka, Jacek Chrulski, quoted by tvn24.pl. As he emphasized, you can give money once or in installments.
18 teachers decided on such a step. The municipality intends to take legal steps to the others. “There must be an attempt through court proceedings to recover these amounts” – announces Chrulski.
Lawyer: the employee is not guilty of
As tvn24.pl writes, teachers emphasize that overstated payments were the result of an employer's mistake and cannot be responsible for other people's mistakes. Some also indicate that the return of such sums would heavily charge their home budgets.
Legal councilor Ewa Moroz-Usmowicz in an interview with tvn24.pl explains that the obligation to donate money is not obvious at all. “The limitation of claims from the employment relationship is three years. Therefore, if we can talk about any undue benefit, it is at most for the last three years” – he explains. – “In addition, the benefit is not undue if the employee could not assess the employer's error. If the error lies with the employer and it was not such an obvious error as, for example, a three -time remuneration paid at once, but a bad settlement of overtime, then I do not see the employee's mistake or grounds for return.”
