Gigi Becali (67 years old), the boss of FCSB, claims that he won the trial in which CSA Steaua Bucharest is asking him for compensation of 37 million euros for the illegal use of the Stela brand, in the sense that the judges determined that assessment to be invalid.
The legal battles between FCSB and CSA Steaua were, for the most part, settled. The Steaua brand used by Gigi Becali's club was cancelled, the courts determined that the track record between 1947 and 1998 belongs to Club Sportiv al Armatei, and FCSB also lost a third lawsuit, in which it requested the cancellation of the brands that Steaua has in its track record.
All these resolutions allowed the reopening of the process in which CSA Steaua requests compensation in the amount of 36.8 million euros, according to an evaluation carried out in 2016.
At the first deadline, set for April 8, all the judges could do was to set a new deadline, on the grounds that FCSB's lawyer, Adrian Căvescu, cited the impossibility of appearing before the court.
Gigi Becali, after the term of the damage process: “It's over, the expertise no longer exists in the process”
A new deadline was set today, May 6, the day the judges determined that that evaluation report on which CSA Steaua relied is inadmissible. This means that if the plaintiffs ultimately win, the damages will be recalculated from scratch.
Gigi Becali was jubilant following the decision.
“It's over! There is no more damage because they didn't ask for expertise, and the expertise they brought to the file is not legal. And the judge, today, didn't approve that expertise, it no longer exists in the process. Goodbye, it's over!
Now there can only be evidence with witnesses and documents. I will bring witnesses and they, no problem. One says he sold three scarves, another says he didn't sell three scarves.
When in fact I was the man who put money into football and he is the one who sold signs with the Star based on the money I put into football. If we didn't perform, he had nothing left to sell,” Becali told fanatik.ro.
Another Premier League club lawyer, Dan Iditaconfirmed that “I removed that expert report in which the damage was assessed at 37,000,000 euros”, but added that “I cannot say that I gained anything by this fact”.
Florin Talpan, for GSP: “I am not worried about this situation”. And an attack on Adrian Căvescu
I also requested the opinion of Stella's jurist, Florin Talpan, who did not miss the opportunity to sting the opposing camp with allusions to the excuses invoked by the lawyer Adrian Căvescu for not appearing at the previous deadline.
“I'm not worried about this situation and I don't use to pronounce or brag at the beginning of a trial, as Cavescu does, I only laugh at the end — as I did in dozens of lawsuits won.
Instead, repeated requests for suspensions and adjournments based on one-way plane tickets, bought a day before the deadline and at a cost of approximately 100 leiraises serious questions about the seriousness and good organization of the defenses invoked.
We will draw the conclusions together at the end”, Florin Talpan said.
