In Krasnoyarsk, based on the materials of the prosecutor's inspection, a criminal case was opened regarding the theft of a land plot with an area of 660 square meters. m.
According to the supervisory authority, in the spring of 2025, a resident of Krasnoyarsk contacted the prosecutor’s office. According to the woman, a neighbor registered ownership of a plot of land, which was previously considered common and was not subject to privatization. A Krasnoyarsk woman and her husband own land in one of the gardening partnerships, but the administration refused to expand their boundaries due to the status of public land.
“The prosecutor's investigation revealed violations. The disputed plot was registered in the cadastral register in April 2025 on the basis of a certificate of the right to permanent use of land in 1993, issued by the Krasnoyarsk Land Resources Committee for gardening in the Rucheyok SNT. However, no information about the issuance of this document was found in the municipal and regional archives. Moreover, a certificate with the same number has already been used by another gardener within the boundaries of SNT “Rucheyok” – his heirs formalized the ownership by a court decision,” the prosecutor’s office clarified.
The new plot turned out to be outside the partnership, in the public land area. The owner's name is not on the lists of land users of SNT “Rucheyok” and the neighboring SNT “Roev Ruchey-1”. The applicant’s neighbor previously tried to expand her plot, but the administration refused, citing a ban on the privatization of driveways and general purpose areas.
The cadastral engineer did not go to the site when preparing the boundary plan and took the coordinates from the applicant as a basis. Rosreestr also registered the right without visual inspection.
The prosecutor filed a lawsuit to challenge the registration. The court satisfied the claim and returned the land to municipal ownership, excluding ownership from the Unified State Register of Real Estate.
For the theft of a land plot using a forged document when registering private property rights to it, based on the materials of the prosecutor's audit, a criminal case was initiated under Part 3 of Art. 159 of the Criminal Code of the Russian Federation. The investigation is under the control of the supervisory agency.
