A surprising decision regarding the Warsaw “Hong Kong”. A class action lawsuit in the background


The judgment of the Local Government Appeals Board was issued on February 13. According to “Wyborcza” information, he agrees with the officials of the Warsaw City Hall who refuse to confirm the independence of the premises in Bliska Wola Tower. It is a complex of three connected skyscrapers, some of which were built on the basis of a building permit issued for a hotel. There are approx. 1.5 thousand people in three buildings. premises.
In the justification for the decision, the SKO stated that the facility “is not intended to operate many independent hotel units, but an integral part of the facility for hotel purposes, functioning as one functional and utility unit,” quoted “Wyborcza.”

From the very beginning, the estate aroused controversy, including: with its specific layout and overwhelming appearance, reminiscent of Asian metropolises. However, the dispute over the Bliska Wola Tower facility is about something else – resolving the status of 157 “investment apartments” that were built on the basis of a building permit for the hotel. Therefore, they cannot be sold as separate apartments. It is also impossible to sign contracts with buyers of other apartments until the issue of the “hotel” apartments is resolved.

The decision of the SKO confirmed the arguments of the city, which from 2022 refuses to issue the so-called certificates of independence of premises. In a comment for “Wyborcza”, the city hall emphasized that this is only a confirmation of the “factual situation”. JW Construction has not yet commented on the situation.
The decision of the SKO can be appealed to the Provincial Administrative Court. This verdict, however, is not everything – JW Construction clients, who are fed up with the state of limbo and the fact that they are still unable to sign apartment contracts, have launched a class action lawsuit against the developer. Małgorzata Rothert, the city's consumer ombudsman, joined this lawsuit – reports “Wyborcza”.
