A California court did not reject the lawsuit against Elon Musk and Tesla. It's about copyright

According to Reuters, in the preliminary ruling published on Tuesday, Judge Wu emphasized that Alcon's allegations of copying material from the film are sufficiently substantiated to warrant further investigation.

If the ruling is formally adopted, it will be the second time a judge has rejected Tesla and Musk's attempt to dismiss the studio's claims. Earlier last year, however, the court dismissed Alcon's trademark claims, which were also brought against Warner Bros. Discovery, the film's distributor.
Dispute over an autonomous taxi and film materials
Studio Alcon, responsible for the production of “Blade Runner 2049” – the sequel to the cult “Blade Runner” from 1982 – claims that Tesla used artificial intelligence-generated images that mimicked scenes from the movie. These materials were to be used during the presentation of the new Tesla cybertaxi model, planned for 2024. Moreover, the studio emphasizes that it had previously refused to allow Warner Bros. consent to use these shots in connection with the event.
Alcon accuses Tesla and Musk of copyright infringement and of implying false support for the presentation.

In a statement, the studio noted that the court's decision shows the seriousness of the allegations, which require further investigation and disclosure of evidence. “If the parties do not reach an agreement, the case will be continued,” it added.
Judge: “It's too early to assess fair use”
Judge Wu noted that at the current stage of the case, it is not yet possible to clearly determine whether the use of materials from “Blade Runner 2049” by Tesla and Musk falls within the limits of fair use.
Therefore, despite the preliminary ruling on the credibility of Alcon's allegations, this issue remains open.

Tesla and Warner Bros. spokesmen did not respond to requests for comment from Reuters. Meanwhile, the case is attracting media attention, emphasizing the important role copyright plays in the era of increasingly advanced technologies and artificial intelligence.
