Bolojan, warning for the CCR after the repeated postponements of the decision on the magistrates' pensions

Prime Minister Ilie Bolojan announced on Wednesday evening that he will inform the Constitutional Court today, February 5, “about the consequences” of the postponement of some decisions regarding magistrates' pensions, saying that, on this issue, Romania registers “a withholding of 230 million euros”.

“It is necessary to accelerate the financing from the PNRR, conditional on the fulfillment of the milestones. At milestone 215, regarding the magistrates' pensions, we have a withholding of 230 million euros. The European Commission considers that the milestone has not been fulfilled”, declared Ilie Bolojan, on Wednesday evening, in a press conference at the Victoria Palace.

In this regard, the prime minister said that if a decision is not taken, “the probability of losing this money is very high.”

“Tomorrow (Thursday – no) I will inform the Constitutional Court about the consequences of postponing some decisions. An attempt was made to solve this injustice last year. There was a postponement. And then, the second attempt. There were these postponements in a cascade. In the conditions in which no decision will be made and it will be postponed again, the probability of losing this money is very high. And I think that every institution must be informed about the consequences of certain decisions. It is important for us to close all aspects related to these clarifications, because we have 2.6 billion euros to collect”, declared Ilie Bolojan.

The Prime Minister highlighted the importance of clarifying these aspects, so that Romania can collect the funds necessary to complete the projects from the PNRR by August.

“The faster we solve all these problems related to this payment request, the more we have this money at our disposal, which means for us the ability to pay our builders, without delays, and to keep a good pace of the works, so that together with the other payment requests that we have to submit – but we can submit them only after we finish the previous request – we can complete these works by August, so that Romania does not lose these money,” said Bolojan.

Four postponements

The Constitutional Court has postponed a decision on the magistrates' pension law four times, with the latest postponement set for February 11, 2026.

The ruling on the objection of the High Court, led by Lia Savonea, was postponed to 10, 28 and 29 December 2025 and 16 January 2026.

At the first CCR meeting, on December 10, 2025, the constitutional judges postponed taking a decision. Later, at the meeting on December 28, four judges, all proposed by the PSD – Gheorghe Stan, Bogdan Licu, Mihai Busuioc and Cristian Deliorga – left the meeting, so no decision could be made.

On December 29, when the session was resumed, the four judges who had left the courtroom the day before did not show up at all.

On January 16, the Constitutional Court announced that it decided to postpone the hearing, after new documents were submitted and the constitutional judges have to analyze them.
