The Russian State Duma has approved, in the first reading, a draft law that expands the powers of the Federal Security Service (FSB) in terms of restricting access to communications. Amendments to the Communications Act, tabled in Parliament in November, allow for the disconnection not only of mobile communications, but also of fixed broadband internet, at the request of the FSB, to ensure security. In such situations, telecommunications operators are exempted from any liability towards subscribers, Mezha writes.

“The purpose of the draft law is to regulate relations in the field of security assurance, in accordance with the directions of activity of the FSB of Russia and the fight against terrorism. The application of the measures provided for by this draft will not generate negative socio-economic, financial or other consequences, including for the business environment”it is stated in the explanatory note.

Background of the project and its implications

During the preliminary review of the document, the Deputy Minister of Digital Development, Ivan Lebedev, said that the need for changes is related to the numerous lawsuits filed against telecommunications operators. He also stressed that restricting mobile communications should be enforced during drone strikes.

In Russia, restrictions on mobile internet are periodically introduced in the context of drone attacks. Service disruptions are reported in both regions and major cities, including Moscow and St. Petersburg. The authorities usually justify these disconnections by security considerations. In the past, such measures have already led to disruptions in the operation of taxi services, deliveries, online banking services and generated dissatisfaction among the business environment, the publication also notes

The draft law aims to regulate relations in the field of security, in accordance with the directions of activity of the FSB of Russia and counter-terrorism measures. According to the authors, the implementation of the provisions will not have negative socio-economic, financial or other consequences, including on the business environment.

However, despite the assurances offered by the initiators, experts warn of potential risks for the stability of the digital environment and for the activity of companies. The logout mechanism could affect users' access to online services and requires strict monitoring of its effects. Subsequent debates and votes in the second reading will be decisive for the final shape of Internet regulation in Russia.
