On Friday, the Sejm adopted an amendment to the act introducing the position of junior judge assistant for students after the third year of law. The amendment prepared by the Parliamentary Justice Committee was supported by the Ministry of Justice.

431 MPs voted for the adoption of the amendment, no one was against and no one abstained. The MPs also accepted one amendment proposed by the Civic Coalition and rejected two amendments proposed by the Razem group.

The adopted amendment to the Law on the System of Common Courts aims, among others, to: solve staffing problems in courts, where there is a shortage of judges' assistants and young lawyers often choose the private sector.

Currently, the regulations stipulate that a person who has completed law studies and is at least 23 years old can become a judge's assistant, while the position of a senior judge's assistant can be filled by a person who has served as an assistant for at least 10 years and obtained positive periodic evaluations, or who has passed a judicial or prosecutor's examination.

How much will you earn?

According to the amendment, the position of junior assistant to a judge will be available to people who have completed the third year of uniform master's studies in law, are at least 20 years old, maintain the status of a student and are of “impeccable character”. The expected rates of basic remuneration will be gross: for a junior judge's assistant – PLN 5,500-6,500, for a judge's assistant – PLN 6,500-8,000, and for a senior judge's assistant – PLN 8,000-9,000.

The adopted KO amendment is of an orderly nature. Its aim is to ensure that after the entry into force of the new regulations, the regulation of the Head of the Ministry of Justice regarding the conditions for organizing and conducting an assistant internship does not lose its legal force. The KO Club proposed to temporarily maintain the current regulation in force – for a maximum of 12 months from the entry into force of the Act.

The amendment provides that a person who has been a junior assistant or an assistant for at least seven years, or has passed a professional examination, e.g. a judge's, prosecutor's, lawyer's, etc., may apply for the position of a senior assistant.

What does a referee's assistant do?

According to the provisions of the Law on the Organization of Common Courts, “a judge's assistant performs activities aimed at preparing court cases for consideration and activities related to the administrative activities of courts.” In practice, the judge's assistant prepares cases for hearing and supports the judge in analyzing evidence and preparing judgments.

His most important tasks include, among others: preparing draft orders and judgments or their justifications, analyzing case files, searching for case law and literature useful for examining cases, preparing draft responses and letters, monitoring the status of cases postponed, suspended or awaiting action by a judge or court.
