The president of the Bucharest Court of Appeal (CAB), Liana Arsenie, said on Sunday on Antena 3 that she made “a written request” for “a discussion with the president of the country” and claims that there is “a mathematical but very cynical scenario” that attempts to “take control of the judiciary”. She again accused the Recorder of not asking her for a point of view on the issues presented in the “Captured Justice” press investigation, an allegation denied by the journalists.

“I asked for a discussion with the president of the country, I also made a written request. His lordship's agenda is probably full. Next, I think, I will also be received,” said Liana Arsenie, on Sunday, on Antena 3.

Asked what she would say to Nicușor Dan, she answered: “At this moment, I would ask Mr. President that when he claims that the justice system is run by terror, that the justice system is run by pressure, is run by persecution, to think that the harm that is being done is not directed at those magistrates, but is the harm aimed at the justice system as a whole.”

“It is an evil that is eroding the rule of law, because if citizens no longer trust that the judicial decision is the result of the law and the application of the law, and of the independence and objectivity of the judge, then the rule of law is in danger. The rule of law is not in danger with an independent and impartial judiciary, it is not in danger with a strong body of judges. It is in danger with a politically coordinated judiciary,” continued the head of the CAB.

What he said about the Recorder

The CAB chief claims the Recorder did not ask her for a view on the issues presented in the 'Captured Justice' investigation.

“Unfortunately, I was never asked for a point of view on these allegations. When that press release was released, that's when I first learned what the allegations were,” she said.

Liana Arsenie presented what she claimed were the e-mails sent by the Recorder, in which, according to the moderator, the publication had asked the CAB president for a videotaped interview in which he would answer a few pointed questions about some administrative decisions he had made.

“I was never asked for an interview regarding the issues that were reported in this material,” added Arsenie.

In a January 6 statement, the Recorder had accused the CAB chairwoman of telling a “blatant lie” when she claimed she was not asked for her views before the Justice Captured investigation was published.

“Some of the colleagues claim that their failure is due to abuse”

The head of the CAB also stated that “some of the colleagues, who have lost competitions over time and are not, in fact, able to accept failure, claim that the failure of their reigns occurs against the background of abuse and pressure exerted by the management on the bodies of magistrates”.

“Dragoș Călin is one of our colleagues who accuses the pressure of the Bucharest Court of Appeal management on the judges, because, in this way, it justifies the failure”, she continued, referring to the president of the Romanian Judges' Forum Association.

“They want a takeover of control over the judiciary”

The head of the CAB claims that there is a “mathematical, technical and very cynical plan” through which “a takeover of control over the judicial power” is attempted.

“It seems that they want to take control over the judicial power – and it doesn't just seem like it, it's a mathematical but very cynical scenario, through which they try to preserve power, by controlling the judicial power (…). A mathematical, technical and very cynical plan (…). It seems that this whole plan is very rigorously organized, very rigorously set up, in which we use expressions that can create emotions, we use images that can create emotions, but the need is real, to taking over judicial power”, Liana Arsenie also declared.
