Who is responsible for clearing snow from roofs? The consequences can be very serious


This obligation results directly from the provisions of construction law. The Act requires the owner or manager of the facility to exercise due diligence and ensure safe use of the building in the event of external factors, such as heavy snowfall or other weather phenomena.
The obligation to clear snow from roofs applies to all property owners – both private individuals and communities, housing cooperatives and entrepreneurs managing halls, warehouses and shops. Action should be taken immediately when the thickness or weight of snow may threaten the structure, there is a risk of snow or ice sliding, or weather conditions favor further accumulation of snow cover. There is no statutory minimum snow depth – each time the potential threat should be assessed individually.
What are the penalties for not clearing snow from roofs?
Failure to comply with the obligation to remove snow and ice may result in a ticket or fine, as well as civil liability for damage resulting from negligence, including damage to property or accidents of third parties. In the event of a threat to life or health, managers and owners may also be held criminally liable.
Failure to respond by the owner or manager may result in very serious consequences. The law provides for the following fines and criminal liability:
- mandate up to PLN 500 (city guard or construction supervision),
- police mandate up to PLN 1,000,
- case in court – even up to PLN 5,000,
- Failure to remove hanging icicles may result in a penalty up to PLN 500.
How to remove snow and ice from the roof?
Firefighters remind us that work related to snow removal from roofs should be performed by people with appropriate qualifications and equipment, while observing safety rules. Trying to remove snow from steep or high roofs on your own is dangerous and not recommended.
The police also draw attention to the obligation to keep the sidewalk along the property clean. In case of negligence, the fine may be up to PLN 1,500. Those responsible for snow removal may be held liable if an accident occurs on the property.
