The objections of the AUR lawyer against some CCR judges. How the Bucharest Court of Appeal is contradicted by its own data. Dozens of similar files received a deadline even after two months

All three requests made by the lawyer Silvia Uscov, who contested the appointments of two CCR judges and the Prime Minister's decision to set up a commission to revise the legislation in the judiciary, were made at the Bucharest Court of Appeal on December 30 and 31 and received a trial date of January 5. The court explained that such short terms have been established in all similar processes. The data analyzed by HotNews show something else – 28 of the 38 files from December regarding the suspension of some administrative acts received a deadline of more than 3 weeks.

  • There was only one other case registered and then resolved after 6 days by the Bucharest Court of Appeal. It is the one in which the court accepted the request of the ANCOM employees' union, represented by the law firm founded by Gheorghe Piperea (AUR), to suspend the reorganization of the institution.

Exceptions and waiting record

The Bucharest Court of Appeal – led by Liana Arsenie – reacted on Sunday after HotNews and G4Media wrote that the lawyer Silvia Uscov, member of the AUR, received very short deadlines at the Bucharest Court of Appeal in the files in which she requests the court to suspend the acts by which Mihai Busuioc and Dacian Cosmin Dragoș were appointed judges at the Constitutional Court, respectively the Government's decision regarding the establishment of the justice law reform committee: “Fixing some deadlines court briefs did not represent a discretionary option, but a legal obligation, imposed by the nature of the cases and the mandatory deadlines established by law”.

In the public information sent on Sunday by the Bucharest Court of Appeal, several categories of files are indicated for which the law imposes short trial terms, being considered urgent cases. One of them concerns requests to suspend the execution of administrative acts, “requests that are judged urgently and especially, with close deadlines, established in consideration of the immediate effects of the disputed administrative act”.

The Bucharest Court of Appeal gives as an example 7 cases for which the court set deadlines between 5 and 10 days. Of these, three are the referrals of the lawyer Silvia Uscov.

The file indicated by the Court of Appeal as the one that received the shortest deadline, of two days, in reality received a deadline 45 days after registration. It is about the notification of a company that contested an administrative act issued by the National Office for Gambling. Registered with the Court on December 22, the case received a first court date on February 5, 2026. The company filed a request to the court for a shorter term.

Only this request was judged two days away from the registration of the file, the deadline for the suspension of the administrative act being set for January 14.

Data centralized by HotNews from the court portal show that in December, 38 files were registered at the Bucharest Court of Appeal in which the suspension/execution of administrative acts was requested, as in the case of the appeals made by lawyer Uscov. Of the 38 files, 34 have deadlines longer than two weeks. 28 of the 34 received deadlines of over 20, 30, 40 or even over 50 days.

The record for waiting for a term belongs to the Romanian Rhythmic Gymnastics Federation, which for the request to suspend an administrative act issued by the National Sports Agency received a first court term after 62 days from the registration of the file.

A case of suspension of an administrative act quickly resolved by the Bucharest Court of Appeal concerned one of the reforms of the Bolojan Government – the reorganization of ANCOM. The ANCOM employees' union, represented by the law firm founded by Gheorghe Piperea (AUR), registered the request with the CAB on December 24, and six days later the court resolved it. The Court of Appeal admitted the request and suspended the acts by which ANCOM was reorganized from January 1, 2026, until a decision on the merits.

With the exception of the ANCOM employee file, only one request for the suspension of an administrative act registered in December has been resolved. This is the case of a man from Giurgiu who requested the suspension of an act issued by the Finance Department. All other files registered in December at the Bucharest Court of Appeal have pending deadlines.

The files refer to referrals at the substantive stage. However, late deadlines are also encountered in the case of files under appeal. Also, there are files registered in November, with the same object of activity, which only received court terms in January.
