“That will be decided by the CCR. The president cannot do what he wants”

Gigi Becali (67 years old), the patron of the FCSB, anticipates that the “Novak law” will be judged as constitutional by the CCR and that the president Nicușor Dan will be forced to promulgate it.

  • On November 19, 2025, in the plenary session of the Chamber of Deputies, it was voted that the sports minister's order 500/2022, issued by Eduard Novak, which stipulated the obligation to use 40% Romanian athletes by Romanian clubs, in all sports, at matches organized in the country, should become law, so that sports federations and clubs respect it.
  • President Nicușor Dan chose not to promulgate it, but to send it to the Constitutional Court of Romania (CCR) on grounds of unconstitutionality.
  • “The law adopted by the Parliament violates the principle of non-discrimination and the free movement of workers”, justified the head of state.

Despite the public position adopted by Nicușor Dan, Gigi Becali, the patron of the Romanian football champion, is confident that the CCR judges will judge differently from the president.

Gigi Becali: “CCR will decide that the Novak Law is constitutional”

“I don't mind that he appealed the law to the Constitutional Court. That's his problem.

I think the law doesn't bother. It is not mandatory. You can not respect it and you pay a fine. Admittedly, the fine is a bit high.

In my opinion, it will be said at the CCR that it is positive discrimination. It will be decided that the law is constitutional and the president will promulgate it. He can't do what he wants, there are laws”, Becali said in dialogue with GSP.ro.

Ciprian Paraschiv, the initiator of the law, also relies on such an outcome. On November 25, the AUR deputy explained on GSP Live:

From the outset we must say that in January there is decision 215 given by the ÎCCJ on this case, which says that it is a perfectly applicable law, it is not discriminatory, it respects the principle of proportionality.

Let's also remember the U21 rule, where we talk about the obligation to have players, even more so, Romanian U21 players. And there is a decision of the CNCD, the National Council for Combating Discrimination, which says very clearly that it is a positive discrimination, i.e. recommendable.

And in the White Paper of Sport it is written as explicitly that such measures can be taken to support national sports and national teams.

From a legal point of view, I see no problem with this law being promulgated by the president, especially since he has so many favorable decisions

If the CCR will confirm the law as constitutional, the president will have to promulgate it within a maximum of 10 days after receiving the decision.
