EXCLUSIVE Florin Talpan continues the war with AS 47! He caught the fans' lawyer at the Court's archive: “She ran away when she saw me, I couldn't believe it”

It is about files 34655/3/2016, having as object the damage caused by the FCSB to the Romanian state through the illegal use of the Steaua brand. And about file 31705/3/2015, completed since 2018, after which the jurist Florin Talpan definitively won the name Steaua for the club from Ghencea and the ban on FCSB to use it without the consent of the military group.

The first case has been suspended for the time being, for several years, without any change, and will be reinstated, now that the trial regarding the Steaua club brands has ended.

And on his Facebook page, Colonel Florin Talpan claims that he recently noticed some changes in this file, on the portal of the Bucharest Court. That's why he went to the archive, to analyze those changes and prepare the defense.

However, when he arrived at the archive, he reports that “I found with surprise and indignation that the file was being studied by a third person, who does not have procedural status. More precisely, judge Ana-Maria Ivașciuc allowed (unauthorized) access to the Popescu Corina law firm, which would represent the Stelistilor 1947 Association, to consult and copy files 31705/3/2015 and 34655/3/2016, although there is no legal basis”.

Further, Talpan continued to describe the findings on November 28: “The request for photocopying and study was admitted by the judge by demonstrating the quality of interested person, which has no coverage in the applicable legal provisions, which makes the access completely illegal.

Worse, because I immediately requested clarifications (the delegated person from Popescu's cabinet “hardly” copied the defenses formulated by me in the file, me recognizing my signatures and letterhead) to the archives of the III-a Section of the Bucharest Court.

Who totally illegally brought this person into the archive to copy files quietly, so as not to be disturbed, in a space where only clerks are allowed, without following standard confidentiality and document security procedures. It was probably also served with a coffee”.

He notified the President of the Court, the Judicial Inspection and the Superior Council of Magistracy

In the file 34655/3/2016 it is about the damage of 37 million euros that Steaua is asking from the FCSB for the unjustified use of the brand and identity of the Steaua club.

As a result, Florin Talpan notified the President of the Bucharest Court, the Judicial Inspection and the Superior Council of the Magistracy, signaling the serious violation of the rules regarding the access of other persons, apart from those who represent the litigating parties, to the respective files. Judge Ivașciuc and the person in charge of the archives of Section III of the Bucharest Court are concerned.

Talpan also asked the president of the Bucharest Court to “immediately withdraw the authorization of access to the file of lawyers from the office of Av. Popescu Corina; Verify the circumstances in which illegal access was granted to both files; Communicate the legal basis on the basis of which the third-party lawyer consulted and photographed the files;

Promptly arrange for all photocopied photographs and documents to be destroyed; Provision of administrative/disciplinary measures; Ensuring the future confidentiality of the documents in the files, considering the importance and value of the damage”.

And at the end of the post on Facebook, Florin Talpan added that “it is necessary to investigate possible illegal favoritism or the conflict of interests, considering that the third person who consulted the files had no procedural capacity and was not a party to any of the litigations.

The situation signals procedural deficiencies at the level of Section III, which must be urgently remedied in order to prevent the repetition of similar violations in the future”.

“If AS 47 wants war with me, I'll show them war!”

GSP.ro contacted Colonel Florin Talpan to ask for details. He recounted everything he described in the Facebook post, adding that “I couldn't believe that someone, without any right, could have access to these files. I don't leave things like that! I found out that that lawyer, who initially didn't even want to identify herself when I called the gendarmes, and then ran out the back, would represent that association of supporters, AS 47.

But AS 47 has no standing in the injury case. I know they want to ask to be admitted as interveners, but I will not agree to that. I know that for many years AS 47 has been trying to associate with Steaua club! Why? How much money does this association have, with a capital of 200 lei?!

So far they have not come to any trial with me. Now they want to come, when it comes to a lot of money?! I will never accept this! I don't need any lawyer, no association, I will win this case alone, just like all the others. The people at AS 47 have a grudge against me since I won the brand and wanted me to give it to them for free.

How to do such a thing, but what, it's my brand?! I won it for the Romanian people, for the club, not for a group of supporters! I clearly told them that if they do not submit a document to the Court by Tuesday in which they clearly state that they do not intend to intervene in the damage file and if they do not prove that they have destroyed all the documents copied and photographed by that lawyer, I will move on.

If they want war with me, I will show them war! If they want to make fun of us, that's it. Anyway, they only cause problems and the club pays heavy fines because of them.

This is also because the commanders so far have not set foot in the door. Let the supporters mind their own business, the team! Let them be satisfied that we won their brand, name, track record, colors and that they have a team to cheer for. I don't allow anyone to mock or destroy my work of the last 20 years!”.

“He got it wrong, we have no business getting involved in his or the club's processes”

For their part, representatives of the 1947 Astronomers Association wanted to specify, under the protection of anonymity, that “Florin Talpan misunderstood. We obtained the approval of the president of the Tribunal to study those files in order to take new steps at UEFA. Not to intervene in any file. We are not interested in getting involved in the processes of Talpan or the Steaua club”.
