The plenary session of the Chamber of Deputies adopted on November 12th the RCA Law draft, which will make vehicles that are not subject to registration or registration, such as electric scooters or electric bicycles, also subject to compulsory insurance.

This project expands the definition of the vehicle, so that vehicles that, according to the current legislation, are not subject to registration, notes Agerpres. So, RCA insurance becomes mandatory for e-scooters and bicycles.

Mandatory RCA insurance for e-scooters and bicycles

The Committee for Transport and Infrastructure of the Chamber of Deputies adopted a series of amendments regarding traffic on public roads, the aim being to increase road safety. Also, the legal regime of electric scooters was clarified.

  • Extending the concept of a «bicycle lane» – it will also be intended for the circulation of electric scooters, alongside bicycles.

  • Establishing the minimum age of use. For electric scooters, the driver must be at least 16 years old; for bicycles, the minimum age remains 14 years.

  • The obligation to wear a protective helmet for all users, regardless of age, when moving on the road side. The exception is electric scooters in self-service mode, where users will have to express their explicit consent, through the rental application, that they assume the responsibility of using without a helmet.

  • Introduction of compulsory civil liability insurance (RCA) for electric scooters traveling on public roads. Every scooter will need to have an RCA policy for third party damage, no exceptions. The Financial Supervisory Authority (ASF) will issue the application rules within 60 days of the entry into force of the law.

  • Mandatory road quiz for self-service e-scooter users, before their activation, to check the basics of traffic rules.

  • New rules for user safety. It is forbidden to use a mobile phone or any other distracting devices while driving. Violation of this rule will be penalized as a misdemeanor.

Driving an electric scooter under the influence of alcohol or psychoactive substances becomes a misdemeanor and will be punished with a fine. Also, the refusal of the driver of a bicycle or electric scooter to submit to testing for alcohol or drug consumption will be penalized in the same way.
