The prosecutor’s office stopped the scheme of artificial overestimation of the value of the municipal contract, which allowed the unfair contractor to get more than 3.5 million rubles from the budget.
According to the supervisory authority, in 2023, MKU “Capital Construction Management”, violating the requirements of the Law on the contract system, entered into seven contracts with an individual entrepreneur from Achinsk at once for the overhaul of the building in the village of Bolshaya Ulyu, where the MFC and social protection management are located.
“Contracts were the same, with one execution period and identical conditions. This approach indicated a clear artificial crushing of a single large order for several small ones in order to avoid competitive bidding, ”the prosecutor’s office said.
Law enforcement officers appealed to the Arbitration Court of the region with a claim for recognition of transactions invalid and recovering the amount received by the entrepreneur – 3.5 million rubles.
The court, having studied the evidence presented, satisfied the claims. Now the unscrupulous contractor is obliged to return the money, and the execution of the court decision is taken to control the prosecutor's office.
