Extending until March 4, 2026. The legality of the stay of Ukrainian citizens who escaped from the war, and sealing the system of receiving benefits by foreigners, including the connection of 800 plus payments with professional activity – these are some of the provisions of the Act adopted on Friday by the Sejm.

227 deputies voted for the law, 194 was against and seven abstained.

Earlier, MPs voted a request to join the third reading of the project without re -directing it to the Commission and voted against the conclusion of the parliamentary circle of the confederation of the Polish Crown to reject the act in full. They also rejected the corrections and conclusions of the minority submitted by the opposition.

What corrections were reported to the project

MPs also rejected the minority conclusions submitted by Klaudia Jachira (KO), who wanted, among others Bindings of the 800 plus benefit with the professional activity of not only foreigners living in Poland, but also Polish citizens.

The amendment of the Together Circle did not receive support, which restored the conditions for payment of benefits to the state from the previous bill.

Poland receives 800+ non -working foreigners

The draft act amending certain acts in order to verify the right to family benefits for foreigners and on the conditions of assistance to Ukrainian citizens in connection with the armed conflict in this country was developed after the end of August President Karol Nawrocki informed that he did not sign the amendment to the Act on the aid of Ukrainian citizens. His decision was motivated by, among others The fact that the 800 plus benefit should only be given to Ukrainians who work in Poland.

The regulation seals the system of obtaining benefits for the family by foreigners. The right to these benefits will be associated with professional activity and the education of children at a Polish school, with the exceptions to, for example, people with disabilities. In addition, the right to benefits will be related to foreigners obtaining at least 50 percent. minimum remuneration for work, which means that in 2025 it will be PLN 2333 gross.

ZUS will check every month if foreigners were professionally active. If the foreigner was not active in a given month, the benefit will be suspended and the transfer will not be sent. ZUS will also verify in the register of the Chief Commander of the Border Guard, or a given foreigner has not left Poland.

To allow better identification of foreigners applying for benefits and their children, it will be introduced Obligation to have a PESEL number. When broadcasting PESEL, children's stay in Poland will also be verified.

The new regulations also provide for the integration of databases of various institutions, which is to allow more effective monitoring of the rights of foreigners and eliminate attempts to extort benefits.

Restrictions on the possibility of using healthcare services by adult citizens of Ukraine will also be introduced. It comes, among others for health programs, healing rehabilitation, dental treatment or drug programs.

Pursuant to the Act, the existing provisions regarding the legality of the stay of Ukrainian citizens who fled from the war will be extended until March 4, 2026.

The new solutions are to come into force essentially on the day after being announced in the Journal of Laws.
