ANAF, the guest surprise at weddings and baptisms: “The meal will be expensive.” Would also be targeted by the wedding gift

The ANAF requirement addressed to restaurants to report how many weddings, baptisms and other private events have by the end of 2025 it aroused the discontent. They say that the GDPR rules are violated and that the wedding gift would also be targeted, in addition to the high bureaucracy considering that the e-facing, e-tva and e-casage are already implemented.

Restaurants must report ANAF how many weddings are organizing with how many people

“ANAF request for detailed data on weddings and baptisms in 5 days and invitation to bureaucracy and fear, not to prevent evasion. ANAF requires names, phone numbers and other data about marriages and guests. That is, to know the state who danced at the Serbian at 3 in the morning. What does the GDPR say? Or is it “optional” now?

ANAF wants to know everything about weddings and baptisms, even as little as they have been on the grill. This is not a fight against evasion, it is a Big Brother with all-inclusive menu. If we want results, let's control where there is real fiscal risk, not at every village party“, Said Valentina Saygo, an accounting expert, president of the patronage of accounting entrepreneurs in Romania.

What is the purpose of e-facing, e-tva, e-transport, e-casons, saf-t?

For his part, Sofian Sergiu-Mihai, accounting expert and financial auditor Excelsum Audit & Advisory SRL told “truth“That bureaucracy is already exaggerated in this area.

“As a financial auditor and accounting expert, I appreciate that the intention of ANAF to request companies in the field of Horeca information about weddings, baptisms and other events.

The measure can bring benefits to the budget, but the real impact depends on how it will be applied. Clear, digitized and simple procedures could turn this initiative into a useful tool. A heavy implementation would risk becoming an administrative burden for companies, already suffocated by increased taxes. Entrepreneurs want fiscal predictability, less bureaucracy, generally a state to be articulated on the needs of companies.

Finally, we all understand that we have to increase the degree of collection, but for the entrepreneurs who pay taxes the question is born: what is the E-facture, E-TVA, E-transport, E-Case to mark, SAF-T? If the bureaucratic burden still remains, which should I run? “said the accounting expert for “truth”.

Would also be targeted by the wedding gift

Ana Cernescu, Managing Partner Accountless, told “truth“That”ANAF will be the guest-surprise at weddings and baptisms ”.

“The stated or less declared purpose is to reduce tax evasion and even wash money in a sector where considerable amounts are circulating, but rarely taxed completely. We know that the money has always been the favorite excuse of those who cannot justify smaller or higher wealth. I think the risk analyzes will target both the organizer and the beneficiary.

I think this was not exactly the lack of the Horeca industry, one of the hardest tried not only lately.

Perhaps a more balanced solution was to establish reporting thresholds – for example, for events with over a certain number of guests or with budgets over a certain ceiling. Thus, small and medium -sized businesses would not have had to invest in adapting computer systems or in -law work in Excel just to send data which, in many cases, will not generate any real benefit for the state budget.

As it looks now, the measure seems to be an extra stress, with questionable fiscal benefits. And in the absence of an integrated digital system that allows fast and objective checks, the initiative I do not think will bring benefits. We have been witnessing data collection for some time without seeing targeted actions and reducing large evasion“, Cernescu told”truth”.

GDPR rules are violated

The intention of ANAF to ask the operators in the Horeca field detailed information about the organized events has generated heated debates.

From the position of professional accounting, Cristina Georgeta Vintilă, the founder of the CV group expert, told “truth“That the report required by ANAF must be viewed from two perspectives: that of fiscal efficiency and the real impact on the business environment.

“If it were correctly implemented, the measure could bring an increase in budget income. ANAF would have an additional verification tool and could discover discrepancies between real and reported incomes. But if we talk only about collected and archived tables, without a digital and intelligent processing mechanism, we risk creating a mountain.

Horeca operators, especially SMEs, are already burdened with a large volume of reports to the state, which already lead to extremes that create increasing tensions. The introduction of an additional obligation, which involves detailing each event, means lost time, resources and administrative costs ”, she said.

In addition, the expert added, there is also a confidentiality issue.

“Weddings and baptisms are private events, and data collected about customers can enter the sensitive area regulated by GDPR legislation. The state must clearly explain what type of data they collect, how they store them and how to guarantee their security.

In conclusion, even if the measure proposed by ANAF has a correct intention, applied in the announced form risks becoming a bureaucratic burden than a real evasion tool. In order to be effective, the initiative must be accompanied by data protection guarantees, a digitized analysis framework and a correct approach to the business environment. It is essential to talk about an effective collection, without sacrificing the freedom and development of a vital sector for the Romanian economy ”said the expert for “truth”.

Who was correct, remains fair. Whoever works “in black” will feel pressed

Another accounting expert contacted by “Adevărul”, Nicoleta Arghire representative Intelligent Accounting Solutions, gave the example of a wedding with 200 guests.

“If this information is centralized, ANAF can compare: the capacity of the hall, the number of guests, the menu and the income declared. Let us take a simple example: a wedding with 200 guests, the menu is 300 lei, 60,000 lei should appear in the account. If only 20,000 is included, the difference is lost and the state does not collect VAT and taxes.

At the same time, if the events are more strictly taxed, it is possible that the prices practiced by restaurants and event rooms will increase to cover VAT and taxes to the state budget (here they refer to the subsequent transparency of salaries in the field).

The measure can uniformize the market, reducing the unfair advantage of those who do not declare correctly ”said the expert.

According to her, from the point of view of the amounts collected, in the short term, the effect will be limited. “Who was the right one will remain correct, and who knew how to bypass the rules will try to find new methods.

In the medium term, if the measure applies consistently, it can bring millions of euros to the budget and a more correct competition between companies and, with little they would be covered from the current budget deficit ”she added.

Weddings do not want to know ANAF the details of the party

Regarding the collateral effects, it said that the bureaucracy for restaurants and hotels will increase, which are already suffocated by reports (e-facing, SAF-T, houses connected to ANAF).

On the other hand, added Nicoleta Arghire, a reluctance from the customers may occur, who do not want to know that the details of their party reach ANAF.

“Most likely, the additional costs flowing from the taxation of all income, will be transferred in prices, so the events could be expensive. Instead, the measure can bring equity to the market, eliminating the advantage of those who worked” in black “.

Therefore, the measure makes sense and can bring money to the budget, but it all depends on the norms of applying the new measures. If ANAF only collects papers, without analyzing them intelligently, we will have a lot of agitation and few results. However, if the data is used real in risk analyzes, then we are talking about a more correct market and additional revenues for the state.

Who works “in black”will feel pressed. The state wins if the measure is applied with intelligence and without abuse ”he told “truth”.
