Minister Żurek to the prosecutor's office? PiS will notify the suspicion of committing a crime

PiS deputies: Zbigniew Ziobro and Marcin Warchoł informed that on Wednesday at the District Prosecutor's Office in Warsaw they would notify the suspected crime by the head of MS Waldemar Żurek regarding “he exceeded his rights by unjustified dismissal of court presidents.”


The notification is related to the dismissal at the end of July by the Minister of Justice from the delegation in the Ministry of Justice of 9 judges who signed letters to “Neoks” or are “neoszydzes”. For the same reasons, 46 presidents and vice presidents of courts were also suspended.
During the press conference, Ziobro assessed that the sour soup “in a coarse manner suffered a guarantee of judicial independence, and indirectly independence, dismissing several dozen presidents and vice presidents of the court without a legal basis.” – The argument he used is also another crime in itself, because it is not possible to punish only for the fact that it is applied to the law in Poland – he emphasized.
According to Warchoł, Żurek dismissed the presidents and vice presidents of courts without maintaining the proper procedure, which requires – as he added – the participation of subsequent courts. – Meanwhile, Minister Żurek, dismisses presidents, vice presidents, according to his own political vision – he assessed.
As he said, these people were nominated on positions based on and in the limits of the Act. “Nobody can be punished for applying for applicable law,” he added.

According to him, in contrast to the words of Żurek, who said that the National Court Register generating the costs of compensation from the State Treasury, awarded by the European Court of Human Rights, the state – as he emphasized – will pay compensation to suspended presidents.
Even in December 2023 – shortly after the parliamentary election, after which the current ruling coalition took power – the Sejm adopted a resolution regarding the National Council of the Judiciary, in which it was indicated that three resolutions of the Sejm of 2018, 2021 and 2022 on the election of judges – members of the National Court Register were taken with a harmful violation of the Polish Constitution. Members of the National Court Register elected against the Constitution were called to stop operating in the Council.
The changes introduced for the Government of Law and Justice are questioned by European courts and tribunals, as well as some legal environments and politicians. Pursuant to the amendment to the Act on the National Court Register of 2017, 15 judicial members of the National Court Register elects the Sejm, and not – as it was before – judicial circles.
The current council is already the second chosen after 2017 according to the challenged regulations. The term of office of judicial members of the Council elected by the Sejm expires in 2026. (PAP)
