We are waiting for changes in law because we know that the system has been concreted – said the Minister of Justice, Prosecutor General Waldemar Żurek on Thursday. He also announced changes in the ministry, which in his opinion is very extensive. He dismissed 44 judges and suspended more, including for signing a letter of support to Neoks.
During the Thursday press conference, Minister Żurek emphasized that “the system was concreted” and he disagrees with many solutions. He noted that he must keep “procedural issues”; He also presented an example of changes in the positions of court presidents. – I suspend them today. So this word, as I said “I dismissed” is exaggerated (…), but these people were suspended in the activities of the presidentials – said Żurek.
The head of MS announced that the place of each suspended person will be “appropriate judge in a given court, so the courts are not unheard of”. He emphasized that his decisions did not affect judicial independence, because the judges discussed in “a small extent” due to administrative work. – Now they will definitely return to the room, as this appeal process will end and they will be able to rule much more – he emphasized.
As reported by the minister, they were dismissed, among others Members of the Program Council of the National School of Judiciary and Prosecutor's Office and one of the Minister's representatives. Żurek announced that this is the beginning of major changes in the ministry, because the ministry is “very extensive”. – In the Ministry of Justice there are these proxies of several, perhaps a dozen or so, I have to look at it. For now, I canceled one, because in my opinion some activities of departments, directors of departments duplicate with the scope of the activities of proxies that the minister appointed. I want to change this structure, however, he said.
The minister also cited the example of inquiry commissions, which in his opinion are a “scream of despair.” – I would definitely prefer to fix the institutions that operate, so that the state is strong, but that we do not create an additional superstructure, for which we all have to pay and which is ineffective in my opinion – he said.

Minister of Justice Waldemar Żurek said that the wife of the President of the Constitutional Tribunal Małgorzata Hencel-Święczkowska is one of many suspended presidents and vice presidents of courts. He added that he did not know her and no harassment can be seen in his decision.
During the press conference, the head of MS was asked if the suspension of Małgorzata Hencel-Święczkowska, president of the District Court in Sosnowiec, the wife of the President of the Constitutional Tribunal Bogdan Święczkowski is “personal revenge”.
The minister assured that there was no harassment here and emphasized that he did not know the judge in person. – I learn from the media that he is the wife of a person who is the president of the Constitutional Tribunal – he added. As he said, “all presidents, deputies, who have signed a list of support to the constitution like an organ and those who took part in competitions, which in my opinion, were unlawful.”
He emphasized that the Ministry of Justice must somehow resolve the so -called Neosędziów. – We also have an idea for her. And this will be a project that we will implement and I think that the “neo -sessels” will be satisfied with it – said Żurek.
On Wednesday, the President of the Constitutional Tribunal stated in a statement that the decision to suspend his wife in the function of the president of the court and starting the procedure of dismissal three months before the end of her last term “is personal and is a manifestation of revenge.” He estimated that Minister Żurek “guided by pettiness, he retaliation for the activities of the Constitutional Tribunal, agreeing to his family.”
Święczkowski also stated that the minister's action is completely unlawful in the light of the judgment of the Constitutional Tribunal of October 16, 2024 (reference number K 2/24).
