The Ministry of Justice withdrew from the maintenance boards proposed on Wednesday. The solution will be consulted again – said government spokesman Adam Szłapka after the Friday meeting of the Council of Ministers.



– This table is above all a source of law in any way. It was such information, clue for the courts, for parents, as calculated – emphasized Szłapka, admitting that the solution proposed by the Ministry of Justice caused a lot of controversy. – This tip has been withdrawn and will be consulted again, it should not be afraid in any way – he added.
He reminded that the Ministry of Justice also issued statements on maintenance boards.
According to the information originally provided by MS, the maintenance board was to be a real support for the judge when determining the amount of maintenance – facilitate the assessment of the situation and allow to maintain greater predictability of judgments. At the same time, it was not to limit judicial independence – it would still be possible to an individual approach to each case, taking into account its specificity and exceptional circumstances.
The maintenance table contained model amounts of monthly benefits, calculated on the basis of three key variables: income of the person obliged to pay maintenance, the child's age and the number of children to whom the person is maintenance.
The values presented in the table reflected the estimated monthly costs of satisfying the basic needs of the authorized person, such as food, apartment, education, culture, health, hygiene, transport, communication and other justified expenses. (PAP)
