At the beginning of the year, we informed in Business Insider that the Polish government finally noticed the problem of people experiencing miscarriage. Current regulations do not allow women to take short maternity leave and they deprive them of the right to funeral allowance if they do not know the child of the child. Shortly afterwards, the minister of work Agnieszka Dziemianowicz-Bąk in a conversation with us informed that the ministry was working on legal changes in this matter, and the problem itself called “cruel absurdity”. – Our initial proposal assumes that a medical certificate would be enough to exercise the rights after losing pregnancy. It would not be necessary to determine the sex or a number of other formalities – she said at the time.

Until now, the law applied to women after losing a dramatic obligation to learn about the sex of a child, without whom it was impossible to register the so -called dead birth cards. The lack of a document excluded from the right to a 56-day, fully paid, voluntary maternity leave and funeral allowance. Already in May the ministry It announced that instead of a birth certificate, a simple medical certificate was enough. Now this announcement has become a fact.
The new regulations, prepared in the form of ordinances, will enter into force fourteen days after publishing in the Journal of Laws. In the spring, the ministry estimated that they would be announced in September, but thanks to the acceleration of the legislative process, the deadline was postponed by several weeks, which means that the practical availability of benefits may occur at the end of summer.

Dziemianowicz-Bąk from the beginning of her term of office she called the requirement to determine sex “cruel absurdity”. In a February interview for Business Insider, she admitted that The woman lost not only pregnancy, but also time and money for genetic examinations, and instead of helping, the state “still had suffering”. It was then for the first time that she announced that the medical certificate would replace the birth certificate and a number of other formalities.
Regulations also end financial discrimination in access to the funeral allowance. From the moment the new regulations come into force, the benefit will be entitled to a death card or the same certificate that entitles maternity leave. The ministry emphasizes that the new rules will cover all cases of pregnancy, regardless of its advancement.

Today's signature closes a long -term battle of social organizations, lawyers and parents for real support after losing pregnancy. After the publication of ordinances, Poland will join countries that recognize that in the most difficult moments the procedure cannot be more important than human suffering and the need for a worthy farewell.
