The leader of the senators SOS Romania, Nadia Cerva, challenged at the Constitutional Court of Romania (CCR) and in the Senate the appointment of Mihai Busuioc, the former head of the Court of Accounts, as a constitutional judge, proposed by the PSD.

The appeal made by the senator from the party of Diana Şoșoaca comes in the context in which Mihai Busuioc was supported to reach the PSD CCR judge, and the proposal was voted in the Senate by the PSD-PNL-USR-UDMR coalition.

In the appeal filed with the RCC and Senate, consulted by Hotnews, it is shown that the appointment of Mihai Busuioc to the Constitutional Court was illegal and the decision is revoked because Busuioc “does not meet the legal conditions for occupying this high position”.

What does SOS Romania contest in the appointment of Mihai Busuioc

Cerva claims in his complaint that Mihai Busuioc does not meet the conditions of Article 143 of the Constitution, which stipulates that “the judges of the Constitutional Court must have a higher legal training, high professional competence and at least 18 years in the legal activity or in the higher legal education”.

The leader of the senators SOS Romania claims that Busuioc does not have a “superior legal training”: “it is not sufficient to graduate a higher education institution in the legal field, as” superior “requires this minimum mandatory stage required for any lawyer.”

Nadia Cerva argues that Busuioc has no age of at least 18 years in legal activity or higher legal education, required by the Constitution.

“It is found that Mr. Mihai Busuioc does not fully meet the demands imposed by the criteria regarding the higher legal training, as I explained to the previous one, nor those regarding the age of 18 years in the legal activity, as the professional activity of his reign has been concentrated, as it results from his professional route, predominantly in the field, the field of public administration.

Who is Mihai Busuioc. Old conflict with Sorin Grindeanu

Mihai Busuioc has been holding the position of president of the Court of Accounts since October 2017. Previously, he was the Secretary General of the Government, a position to be noticed after he refused to leave when the conflict between Prime Minister Sorin Grindeanu (current leader of the PSD) and the PSD led by Liviu Dragnea.

One step to be dismissed from the head of the government, Sorin Grindeanu replaced Busuioc from the position of Secretary General of the Government with Victor Ponta. Busuioc initially refused to counter the order of Prime Minister Sorin Grindeanu, which even had his release from office. The conflict between Grindeanu and Dragnea was completed with the dismissal of the Government by censorship motion.

He was considered a close relative of former PSD leader Liviu Dragnea. He was deputy secretary general of the Ministry of Development, during the period when the institution was run Dragnea. After the Ponta government fell in 2015, Busuioc was kept in the technocratic government by this ministry, by Vasile Dîncu.

Previously, he led the National Cadastre Agency (ANCPI), from where he was dismissed by Victor Ponta in 2012.

Busuioc finished the Faculty of Law at Nicolae Titulescu University in Bucharest and has postgraduate courses at the National Defense College.
