The President of Uodo Mirosław Wróblewski asked the Election Control Movement Association with a request to explain in connection with information about the applications of this association unauthorized by the National Electoral Office, which was to be used to verify certificates of voting right.

In the press information on the website of the Personal Data Protection Office, it was announced that the President of UODO asked the Election Control Movement to the Association after receiving the notification about the possibility of irregularities in the data processing process. It is an application unauthorized by the National Electoral Office, which allegedly was to be used to verify certificates of voting right in the past presidential election.

“In the opinion of the President of UODO, the knowledge that has been obtained in the case so far indicates the possibility of irregularities in the process of processing personal data, which may result in a risk of violation of the rights or freedoms of data subjects” – it was indicated.

In a letter addressed to the RKW, the President of UODO asked the Association 10 questions, including he asked to indicate the legal basis for the process of processing personal data, the purpose of their processing and the method of securing data against unauthorized access.

The President of UODO also asked to indicate: specific categories of personal data, which were obtained by the Administrator using the form in the application, the physical place of data storage, the potential encryption method, mechanisms that protect against unauthorized access to data, the legal basis for their collection, and other possible purposes for which the data could be obtained (except for the form of the form).

The explanations and evidence of their confirmation are to be sent to UODO within 14 days of delivery of the letter.

The Association of Election Control Movement – the Power Control Movement was established in December 2015 in response to irregularities, which – according to the representatives of the movement – occurred during local elections in 2014. Before the presidential election, the movement encouraged citizens to be careful of election forgery. One way to avoid them was to be the use of an application for alleged verification of certificates of voting right, which was also used by PiS MP Dariusz Matecki.

Last week, Prime Minister Donald Tusk announced that in connection with this case, the Internal Security Agency submitted to the Warsaw District Prosecutor's Office a notification of suspicion of committing a crime pursuant to art. 249 of the Penal Code regarding the disturbance of the election. “A separate thread – a violation of personal data in connection with this application – is dealt with by the police; this thread will be included in the joint recognition by the District Prosecutor's Office in Warsaw” – added Tusk.

The prosecutor's office then confirmed that notifications (in the plural – PAP) regarding the internet application mentioned by the prime minister; Due to the good of the proceedings, wider information is not given. (PAP)
