This case attracted the attention of the Ombudsman, who asked the National Prosecutor's Office for detailed explanations. On the eve of Easter, an answer obtained from the prosecutor's office was published on the RPO website.

Ombudsman, prof. Marcin Wiącek, officially turned to Dariusz Korneluk, the head of the National Prosecutor's Office, asking to provide accurate information on the course of the interrogation of Barbara Skrzypek.
The Ombudsman emphasized that it is necessary to examine whether during the interrogation it was ensured that the legal provisions and an adequate level of legal protection of the witness were ensured.
In the week preceding Easter, the Ombudsman received a response to his inquiry. Dariusz Korneluk announced that prosecutor Ewa Wrzosek did not agree to participate in the interrogation of lawyer Krzysztof Gotkowicz, who He was to represent Barbara Skrzypek as a representative of the person who was not a party to the proceedingsrecognizing that it was not necessary to protect her interests.
In the explanations sent, Prosecutor Korneluk pointed out that the arguments presented by lawyer Krzysztof Gotkowicz did not justify the admission of the attorney to participate in the procedural activities. In addition, he noted that the decision that will end this procedure will in no way resolve the issue of Barbara Skrzypek's criminal liability.

According to the document published on the RPO website, the prosecutor emphasized that his decision was in line with the current provisions of the criminal procedure, which allow the prosecutor to have such action. Korneluk also explained that the refusal to admit the proxy did not negatively affect the possibility of testifying by Barbara Skrzypek, who did not have the status of a party to the proceedings.
It was also indicated that although the appointment of a representative by a witness is acceptable, the authority conducting the proceedings retains the right to refuse his participation, if he considers that the protection of the interests of the witness does not require the presence of a representative in the course of the action.
