The mayor of the capital, Nicușor Dan, who is applying as an independent for the presidential elections in May, said on Thursday that the decision of the Ploiești Court of Appeal is a “wrong” one, which can be returned by the High Court of Cassation and Justice (ICCJ).

“I think it is an erroneous decision and the Ploiești Court of Appeal did not have the competence to rule on a decision of the Constitutional Court. This is my interpretation. Of course we must respect the judgments, but no one prevents us from commenting. Judge Alexandru Vasile from the Ploieşti Court of Appeal decided, earlier on Thursday, to annul and suspend the decision of the Constitutional Court (CCR) to annul the last year's presidential elections, a decision taken in December 2024.

The decision can be challenged in five days after the court's portal, and the appeal will be tried by the High Court of Justice and Cassation (ICCJ), which, on January 17, definitively rejected Călin Georgescu aimed at resuming the presidential elections.

The RCC decision was challenged at the Ploiești Court of Appeal by a natural person, Gheorghiță Popescu, according to the data on the portal. The court's decision in Ploiești was taken ten days before the first round of the presidential elections.

On December 6, the Constitutional Court annulled the results of the first tour of the presidential elections, won by Călin Georgescu, based on documents desecretized by CSAT, received from SRI, SIE, MAI and STS. The SRI reports talk about an operation prepared in advance, in favor of Călin Georgescu and which has “the operation of a state actor”.

Already, the Prosecutor's Office attached to the Ploiești Court of Appeal has appealed against the decision given by the Ploiești Court of Appeal-the administrative and fiscal litigation section in the file number 301/42/2025, in other words in the case in which Judge Alexandru Vasile decided to suspend the CCR decision, the Public Public Page announced on Thursday.

And the Section for Judges of the Superior Council of Magistracy (CSM) decided to notify the Judicial Inspection to carry out checks on a possible disciplinary deviation from Judge Alexandru Vasile.

The SCM stated, in a statement, that “the disposed measure takes into account the fact that in about 30 other identical causes solved by the courts of appeal in the country the solutions were to reject the action, the judicial practice being unitary in this regard.”
