In the last days, the courts of appeal have registered more than 100 applications regarding the annulment of the Constitutional Court of Presidential Election, according to a verification made by Hotnews, after the decision of the Ploiești Court of Appeal. The submission of the actions in court was done in waves, dozens of applications being filed with each court of appeal.
All the requests solved so far, dozens of them, which represent under half of the submitted ones, have been rejected by the judges. The exception to “reject the line” registered today at the Ploiești Court of Appeal, where Judge Alexandru Vasile admitted such a request and decided to suspend the effects of the Constitutional Court's decision, until the final settlement of the file.
Another full one from the same court rejected a similar request yesterday, made by another person.
The first requests for the annulment of the Constitutional Court's decision regarding the annulment of the presidential elections have been registered from April 8 at the Timișoara Court of Appeal, according to HotNews documentation.
Starting with this date, over 100 similar requests have been registered with the courts of appeal across the country. The wave of applications looks like a coordinated movement, given that dozens of applications are submitted in distinct days.
The information about the multitude of requests was first reported on Facebook, by a teacher from UBB Cluj-Napoca, and in the newsletter of former journalist Bianca Oanea.
Less than half of the applications have been resolved so far. Except for the decision of Judge Alexandru Vasile from the Ploiești Court of Appeal, in all the solved files, the magistrates rejected the requests invoking the same reason: the decision of the Constitutional Court is not within the jurisdiction of the courts.
In all the already resolved files, the petitioners challenged the decisions.
Cristi Dănileț, the former judge and former member of the SCM, argues, in a Facebook post, that, in the case of the Ploiești Court of Appeal, “the file was directed to a certain judge”.
“In order to circumvent the computerized random distribution system, several persons-who are not related to the right-have filed the same request to the same court (Ploiești Court of Appeal), on the same day. The files were registered one after another, from no 292 to 304. In this way, it is enough for one to arrive”.
