On Tuesday, the Sejm Infrastructure Committee proposed amendments to the parliamentary bill on the disclosure of housing prices by developers. One of them provides for shortening to 2 months the deadline in which developers will have to adapt to the new requirements after the entry into force of the Act.


It is about the draft amendment to the Act on the protection of the rights of the buyer of a residential premises or a single -family house and a developer guarantee fund and the Act on competition and consumer protection prepared by MPs of Poland 2050. He predicts that developers would run websites on which housing prices are to be given from the beginning of sales to its termination. According to the project, the developer will also have to inform about all price changes and additional purchase costs. In the event of failure to comply with the obligation, the developer could be checked by the Office of Competition and Consumer Protection (UOKiK) and punished with a fine of 4 percent. annual turnover.
During the Tuesday meeting, the Commission introduced a number of amendments to the project. One of them predicts that the buyer may demand sales at a more favorable price for him in the event of a discrepancy between the price given on the developer's website and the price offered at the conclusion of the contract.
It was also proposed to shorten the date when developers will have to adapt to the new requirements after the entry into force of the Act – from 6 to 2 months. Other corrections are clarifying.
During the meeting, the meeting was left by PiS deputies. “Because we see that this bill has no problem solve, but from what you say this is a laws with developers, pretending that you will solve a social problem that you will not solve at all. Because instead of different offer prices you will be able to present one offer price, but different discounts to offer different clients – we do not want to take part in this” – said PiS MP Piotr Uściński before leaving the room.
Deputy Minister of Development Tomasz Lewandowski, present at the meeting, emphasized that Mrit “positively assesses the project and positively assesses the direction of changes”. The Vice President of UOKiK Daniel Mańkowski spoke in a similar tone. “We appreciate work on this project. We think these changes are needed,” he said.
Deputy Minister of Development Michał Jaros during the first reading at the plenary meeting of the Sejm reminded that his ministry is working on establishing a portal of data on trading in apartments (house), which is to collect data on transaction prices on the real estate market. These data are to come from notarial acts and be divided into the secondary and primary market as well as the location. In Jaros's opinion, the combination of openness of the offer and transaction prices would actually improve the negotiating position for potential buyers of the property.
