The United States is experiencing a large legal dispute after a federal court of appeal established on Friday, August 29, that much of the customs duties imposed by President Donald Trump are illegal.

The judgment, taken by a majority of seven votes at four, marks a significant defeat for the protective strategy of the White House leader, who introduced these measures shortly after returning to power, according to Agerpres.

However, the application of the decision is suspended until October 14, which means that the contested surcharge remain, for the moment, in force. Trump's reaction came immediately, on his social social network.

“All customs duties are still in force”, transmitted the US president, adding: “Now, with the help of the Supreme Court of the United States, we will use them to serve our country.”

Donald Trump has confirmed that he intends to take the dispute to the Supreme Court, a court where the conservative majority is consolidated.

Arguments against taxes

The judges of the Federal Court of Appeal who declared the illegal taxes have emphasized that the American law offers the president “significant powers” to act in national emergency situations, but these powers do not explicitly include the possibility of imposing customs duties and rates, competence that belongs to the Congress.

In addition, the decision shows that Trump cannot introduce “discriminatory, without time or sum” rates.

The taxes concerned were applied, in practice, almost all the products imported into the US, regardless of their origin, and ranged from 10% and 50%. These were added to already existing sectoral surcharge, such as those in the automotive, steel or aluminum.

The president's reaction

On the Social Truth, Donald Trump harshly charged the Federal Court of Appeal, calling him “extremely politicized”. In his opinion, the renunciation of the surcharge would represent “a complete catastrophe, which would be” destroyed “.

The concerns of the American leader related to his measures are not new, since the beginning of August, he publicly recognizing the possibility that the state is obliged to return “huge amounts”, while his administration boasts additional income of tens of billions of dollars generated by these taxes.

Economic and political implications

Donald Trump is now afraid that he will lose an important lever in commercial negotiations with his partners. So far, the mere threat with high customs duties has determined many of them to avoid reprisals and accept the additional opening of markets for American products.

The file was first analyzed by the International Court of Commerce (ITC), which since May concluded that Donald Trump has exceeded his prerogatives by introducing these generalized measures.
