An important judgment in Zakopane. Five illegal demolition houses

On Wednesday, the District Court in Zakopane ruled the obligation to demolish five buildings erected in the agricultural area in Bachledzki Wierch. The houses were built in the Zakopane Kotlina Cultural Park, where buildings are banned.


The court found the guilty resident of Zakopane, who, contrary to the regulations, raised the facilities and hardened the area. In addition to the demolition order, the obligation to restore the plot to its original state was decided. The man is also to pay 5,000 PLN fine – this is the maximum penalty provided for in the Penal Code for this type of act – and cover the costs of the proceedings.
– There is no doubt that the buildings were built in agricultural and protected area. The spatial development plan does not provide for building possibilities here – judge Janusz Knapczyk justified the judgment. As he pointed out, the action was intentional, because the accused had already been pending in a similar case.

The court did not specify the deadline for the demolition, considering that after the judgment becomes final, the action should be taken immediately. It was also emphasized that there is no need to obtain additional administrative decisions in this matter.
– We are satisfied with the judgment, which fully corresponds to our conclusion to restore the previous state. However, we are worried about the lack of a set demolition date, because we expect an appeal. This ruling is precedent, because houses have not been demolished in Zakopane since the 1960s – said Małgorzata Staszel, coordinator of the Kalina Zakopane Park at the Zakopane City Hall.
The accused or his defender did not appear on the announcement of the sentence.

Bachledzki Wierch is an agricultural area on a hill between the center of Zakopane and Olcza. These are private areas, and the ridge runs a tourist trail. (PAP)
