The five officials held qualified digital certificates that they used to represent the interests of private companies, while at the same time, control duties on them.
What did ANAF inspectors discovered
According to the law (art. 44 letter a) of Law no. 207/2015 regarding the Fiscal Procedure Code), a civil servant cannot, at the same time, be an agent or representative of a legal person in relation to his function (art. 94 and art. 96 of Law no. 161/2003 regarding some measures to ensure transparency in the exercise of public dignities, public functions and in the business environment, prevention and sanctioning of corruption).
The five employees did not comply with these provisions, being involved in fiscal administration procedures for taxpayers they represented.
ANAF has announced that, given the severity of the situation, the National Integrity Agency (ANI) will notify.
This case comes in the context in which ANAF periodically organizes training sessions for employees on ethics, incompatibilities and conflicts of interest. The institution states that it will intensify the checks to prevent such situations in the future.
On this type of situation the attention and former head of the Treasury, Lucian Heiuș, also attracted the attention and former head of the Fiscal.

“In addition to the fact that these officials often make mistakes in the accounting documents, this is also illegal. Because they are not allowed to do so, they receive money in black, the state being thus harmed by the taxes and taxes not charged,” he says.
Besides, he says heiuș, they are in a true conflict of interest!
“The ANAF employee will not verify the companies to which he himself keeps accounting whether or not they have irregularities. Only in my activity I have identified many such cases. I sent them to the disciplinary commission. Some were expelled,” explained the former head of the Treasury.
According to him, some businessmen complained after finding that they were taking fines because of the acts wrongly drawn up by the Finance officials.
“A solution would be for the establishment of the company to transmit to ANAF a contract concluded with the accounting expert, including accounting companies, and the Treasury will no longer try to talk directly with the Contractor, who often does not understand anything from those documents.
