The prosecutors of the National Anticorruption Directorate (DNA) have sued 26 persons and companies, including the Botosani Environmental Guard and employees of the Botosani Environmental Protection Agency, who are accused of protecting the interests of companies that did not comply with the environmental norms. Thus, some of the commissioners are also accused of taking bribes because they received money in order not to apply the sanctions that were imposed following checks, informs news.ro.
Thus, Liliana Popovici, Environmental Commissioner within the National Environmental Guard, the Botosani County Commissioner, was sent to court for committing 11 offenses; abuse in the service if the civil servant obtained for himself or another an undue use (10 offenses of auto, a complicity and an instigation); offenses of intellectual false (10 offenses of auto, a complicity and an instigation); Installation to false in documents under private signature; The use, in any way, directly or indirectly, of information that is not intended for publicity or allowing the access of unauthorized persons to this information, for the purpose of obtaining for themselves or for another money, goods or other undue benefits in continuous form (14 material acts), as well as complicity in the aforementioned crime.
Dozens of offenses inventoried by prosecutors

At the same time, the DNA prosecutors also sent to court by Claudiu-Daniel Chelariu, mayor of Mihălăşeni commune, for committing the crime of bribery, on DC and, administrators of some companies for committing crimes of complicity to abuse in the service with obtaining unquestionable benefits, for false intellectual, bribe, but also several legal persons and their representatives.
“Between April-October 2022, the defendants mentioned above, civil servants within the National Environmental Guard, the Botoşani County Commissioner and the Agency for the Protection of the Botosani Environment, would have defectively fulfilled their service duties, by violating the legal provisions, in the context of the environmental activities and control activities. Administrative – territorial (environmental commissioners) or in the context of the activity of issuing/revising/granting the annual visa.
They added that they would be omitted to attest to the control documentation drawn up, on the occasion of the controls carried out, all the facts of violating the environmental legislation or would have attested the truths in charge of the non -compliances/violations of the identified environmental legislation, for which the legal sanctions would not be applied.
Bribe in the form of used cars
“For example, the defendants, civil servants, would not have applied the corresponding sanctions in the case of vegetation fires that they knew would have been intentionally provoked, in the same manner proceeding in the case of illegal storage of constructions and demolitions or in terms of improper records of the oil and the access to the chemicals. which are not intended for the publicity of some economic agents that they would have announced on the notifications/ controls that targeted them or other controls that were to be carried out ”, the source said.
The investigators mentioned that for the “services” offered, Liliana Popovici and Ovidiu Rotaru, as environmental commissioners, would have claimed and received, directly or through intermediary, amounts of money or other undue benefits, between 300 – 1,000 lei, as well as other undue benefits (for example three tons of waste material, 500 kg).
They mentioned that in September-October 2022, Florin Radeş would have claimed from different economic agents, through their representatives or in the context of requests formulated for their own projects or for persons close to them, benefits that are not due, respectively used cars that correspond to the requirements to obtain the reduction in the purchase of a new car, for the end of the car, used machines, in connection with the issuance/revision/granting of the annual visa, the environmental authorization, in order not to suspend the environmental authorization or in exchange for warning over unexpected controls.
He would also have claimed and received an amount of money and undue benefits from an economic agent for issuing the environmental authorization. In addition, he would have offered “help” to some of the representatives of the economic agents, by attesting the aspects inadequate to the truth in the content of the documentation necessary to obtain the environmental opinions.
