The Instagram woman filed a lawsuit against the Japanese food delivery network Yobidoyobi and plans to receive 3.3 million rubles for using her track and image in their advertising. He says: at first the guys tried to buy the rights, were refused and, out of spite, made an offensive video.
They started swinging in March. When the team of Dasha Zoteeva (the artist’s name) saw the “Yobidoyobi” video on the forbidden instagram. There: a whole clip with the motif “For money, yes,” an actress very similar to Instasamka, and other obvious things. They sent a pre-trial claim (pictured) demanding that everything be deleted and that they pay three million rubles for copyright, 500k rubles for moral damages and 150k for a lawyer’s work.
But Yobidoyobi has its own position. Previously, they negotiated to make a video with Zoteeva, but they were refused. So we filmed it ourselves. And at the pre-trial, the artists said: this is a parody, the song is different, and Instagram is completely prohibited in the Russian Federation – therefore this cannot be regarded as advertising. In addition, they added: the image of Instasamka is bad, harmful and promotes antisocial behavior + harms the spiritual and moral education of young people. And it is very doubtful to present it for him. We won't pay.
As a result, the singer’s lawyers went to the arbitration court. They are asking for compensation for the illegal use of their creation and violation of exclusive rights. The amount is the same: three million + 150k for lawyers and 97.4k for expenses.
