The seller on the marketplace sent Krasnoyarsk a toy instead of a tablet and refused to return the money

A resident of Krasnoyarsk complained to Rospotrebnadzor about violation of consumer rights to marketplace “Wildberries”.

A woman ordered a tablet worth just over 7 thousand rubles as a gift for her child. Upon checkout, the product had an excellent rating and many positive reviews. But at the order delivery point, having opened the packaging under the cameras, instead of a gadget, she found a children's toy with chickens. At this point, the product card had changed – the praises disappeared, and the rating dropped to 1.2.





The woman submitted a request for a refund directly to the pickup point, but was refused. The repeated appeal was also rejected. Then the Krasnoyarsk resident turned to Rospotrebnadzor to protect her rights. The specialists explained to her that she acted correctly when they discovered the discrepancy under the surveillance cameras.

“According to the marketplace offer, the buyer is recommended to open the package and check the product for integrity, absence of defects and correct investment in the presence of a pickup point employee, without leaving the customer area or entering the fitting room,” the Department said. — The seller, according to the Law “On the Protection of Consumer Rights,” when selling goods based on a sample and/or description, is obliged to transfer the goods that correspond to the sample and/or description. If the product does not correspond to the description on the card, it means that it is of inadequate quality. The consumer has the right to refuse to receive such goods and demand a refund as for goods of inadequate quality. In this situation, the seller’s refusal is unlawful. In this regard, IP Magamadov S.A. a warning has been issued regarding the inadmissibility of violating mandatory legal requirements.”

The woman was told that if the money is not returned, she has the right to go to court and demand: compensation for losses, payment of a penalty – 1% of the price of the goods for each day of delay in satisfying the request for a refund, compensation for moral damage and payment of a fine – 50% of the amount awarded in her favor.
