On Thursday, the Prosecutor General provided the Speaker of the Sejm with information regarding the charges brought against M. Morawiecki, M. Błaszczak and K. Ardanowski. PG's spokeswoman, prosecutor Anna Adamiak, emphasized that this may be the basis for considering whether there are grounds for holding them liable before the Court of Justice.


“Today, Prosecutor General Waldemar Żurek provided the Speaker of the Sejm of the Republic of Poland, Włodzimierz Czarzasty, with information regarding the presentation of charges against Mateusz M., Mariusz B. and Krzysztof A. – members of the Council of Ministers – of committing crimes related to the positions they hold,” said prosecutor Adamiak.
She added that the basis for providing this information is Art. 2(4a) of the Act on the State Tribunal, which obliges the prosecutor to notify the Speaker of the Sejm about conducting criminal proceedings against a member of the Council of Ministers.
Proc. Adamiak indicated that providing information in this mode may constitute the basis for
consideration by the Sejm whether the violations of law described in the decisions on presenting charges and committed in connection with their positions in the Council of Ministers may constitute a constitutional tort, and thus whether there are grounds for potentially holding Mateusz M., Mariusz B. and Krzysztof A. constitutionally liable before the State Tribunal.
She noted that it was possible to bring charges against these persons, who benefited from immunity protection, of committing official crimes after the Sejm consented to holding them criminally liable for prohibited acts described in the prosecutor's applications.
Over the last few months, former Prime Minister Mateusz Morawiecki, former head of the Ministry of National Defense Mariusz Błaszczak and former Minister of Agriculture Krzysztof Ardanowski have heard charges in the course of criminal proceedings conducted by prosecutors.
Morawiecki heard in February this year. allegations of exceeding powers and failure to fulfill official duties regarding the organization of correspondence elections in 2020. As the head of government in the spring of 2020 (during the COVID-19 pandemic), Morawiecki ordered Poczta Polska to take the necessary actions to prepare and conduct the presidential elections, which, due to the spread of the coronavirus, were to be held on May 10, 2020 only by correspondence. The investigation into the postal elections is conducted by the District Prosecutor's Office in Warsaw.
In March this year he heard the charges Mariusz Błaszczakin an investigation conducted by the Military Affairs Department of the District Prosecutor's Office in Warsaw. The case concerns the declassification and subsequent public disclosure in September 2023 of part of the document of the plan for the use of the Polish Armed Forces “Warta”. In this case, in August this year The prosecutor's office filed an indictment against the former head of the Ministry of National Defense.
Also in March this year, Jan Krzysztof Ardanowski was charged. The investigation conducted by the Regional Prosecutor's Office in Warsaw includes, among others: for causing bank and credit guarantees to be granted, contrary to the regulations.
According to art. 156 section 1 of the Constitution of the Republic of Poland, members of the government are liable to the Constitutional Tribunal for violating the constitution or laws, as well as for crimes committed in connection with their position.
A few days ago, the Prosecutor General provided the Speaker of the Sejm, Włodzimierz Czarzasty, with information about the content of the charges that the prosecutor's office wants to bring against former Minister of Justice Ziobro in connection with the Justice Fund case. The Marshal announced on Wednesday that the leaders of the parties forming the government coalition decided to submit a preliminary motion to bring Ziobro before the Court of Justice.
Pursuant to the regulations, the initial motion to bring a member of the Council of Ministers before the Court of Justice must meet the conditions required by the provisions of the Code of Criminal Procedure. After its adoption by the Marshal of the Sejm, it is sent to the Constitutional Responsibility Committee, which initiates proceedings, including: by interviewing witnesses and collecting evidence. The committee's work ends with the adoption of a report in which it requests that the person be held accountable before the Court of Justice or that the proceedings be discontinued. The resolution to hold the minister accountable to the Court of Justice is adopted by the Sejm by a majority of 3/5 of the statutory number of deputies (276 votes).
Gawkowski on the allegations against former members of the government: everyone who broke the law is now responsible for it

– There was Romanowski, there was Ziobro, there is Morawiecki, there is Błaszczak. Step by step, all those who broke the law in Poland, who decided not to respect the constitution and, in fact, build an authoritarian state are responsible for it today, Gawkowski noted.
When asked if he could imagine the State Tribunal in this case, the Deputy Prime Minister said he “can imagine because it is the right solution.” As he noted, there are many crimes and many elements indicating that even organized criminal groups operated there. – PiS politicians must know that law and justice are coming. First the prosecutor's office, now the State Tribunal and all this will happen, he emphasized.
– PiS politicians deliberately violated the text of the constitution, they did not respect the regulations, they did not care about the laws. The Penal Code was only a name for them, but it was not a method of complying with things such as the ministry's guidelines – said the Minister of Digital Affairs. – For this today comes the punishment – he added.
