A resident of the Krasnoyarsk Territory sued for three times the cost of an unsuitable auto part

Rospotrebnadzor of the Krasnoyarsk Territory helped protect the consumer rights of a resident of Achinsk, who did not want to voluntarily return money for an unsuitable product.
A man bought spare parts for his car in an online store. But when installing them at a car service center, it turned out that one spare part – the front stabilizer – was not the right size. The buyer asked the seller to return the money for it, but he refused.
“Expert LLC reported that a refund is not possible, since the presentation of the spare part was not preserved – upon inspection, mechanical damage was revealed (chips and scuffs on the paint layer), including on the threads, which indicates the installation of the spare part. The seller did not take into account the buyer’s explanations that without opening the packaging of the spare part it was impossible to determine whether it was suitable or not,” Rospotrebnadzor said.
Since it was not possible to resolve the dispute out of court, the Department’s specialists filed a lawsuit. The court decided to recover from Expert LLC in favor of the Achin resident 5,263 rubles: 1,509 rubles – the cost of the spare part; 2,000 rubles – moral damage and 1,754 rubles – a fine. The decision came into force.
