Reversal of the situation in the case of Mario Iorgulescu » The file will be sent for retrial

The High Court of Cassation and Justice decided, on Wednesday, March 4, that the file of Mario Iorgulescu, son of Gino Iorgulescu, will return to the Bucharest Court of Appeal.
This decision comes after the prosecutors appealed the decision by which Mario was spared 8 months in prison, because the crime of driving a vehicle under the influence of alcohol or drugs would have expired, according to libertatea.ro.
Mario Iorgulescu's case will be re-judged
The son of the LPF president was sentenced to 13 years and eight months in prison. He escaped the old sentence once, after the Supreme Court magistrates overturned his murder conviction and was left with a lesser sentence. In the end, he only has 8 years to serve, but now after the ÎCCJ's decision, the sentence could be much higher.
Until this moment, Mario Iorgulescu has not served a single day of detention.
Thus, the Bucharest Court of Appeal will reanalyze the individualization of the punishment for driving under the influence of alcohol or drugs, in the case of the fatal accident in 2019.
1890/1/2025 – Admits the cassation appeal filed by the Prosecutor's Office attached to the Bucharest Court of Appeal against criminal decision no. 949/A of June 12, 2025, pronounced by the Bucharest Court of Appeal – First Criminal Division, in file no. 1549/2/2025 (917/2025). It overturns, in part, the contested decision only with regard to the solution to the termination of the criminal process initiated against the defendant Iorgulescu Gino Mario for committing the crime of driving a vehicle under the influence of alcohol or other substances, provided for by art. 336 para. (1) and (2) Penal Code, as a result of the intervention of the prescription of criminal liability.
Sends the case for retrial the appeals declared by the Prosecutor's Office attached to the Bucharest Court and the defendant Iorgulescu Gino Mario only with regard to the individualization of the punishment for committing the offense of driving a vehicle under the influence of alcohol or other substances, provided for by art. 336 para. (1) and (2) Criminal Code. It upholds the other provisions of the decision. According to art. 275 para. 3 C.proc.pen., judicial expenses remain the responsibility of the state. Definitive. The stages of the Mario Iorgulescu case

On the night of September 7 to 8, 2019, the son of the LPF president got behind the wheel of a luxury car while under the influence of alcohol and drugs. He entered the wrong direction at 143 km/h, causing a fatal accident. Daniel Vicol, the driver of the car hit head-on by Mario Iorgulescu, died on the spot.

Initially, the son of Gino Iorgulescu was accused of murder and received in 2023 a sentence of 15 years and 8 months in prison from the Bucharest Court. Iorgulescu's lawyers appealed the decision, and the Bucharest Court of Appeal reduced the sentence to 13 years and 8 months in prison.

Iorgulescu's team resorted to another appeal, an appeal in cassation. In June 2024, two of the three judges of the ÎCCJ panel decided to cancel the sentencing decision. It is about Adriana Ispas and Lia Savonea. The third judge, Dan Enescu, formulated a separate opinion.
