The Ministry of Digitization is introducing new e-services. Returning to your surname after divorce online


The new regulation is part of the draft act amending certain acts in connection with the development of public registers based on the state register system.

The proposal assumes modification of the provisions of the Family and Guardianship Code, the Act on Population Registration and the Act on Passport Documents.
The aim of the amendment is to improve the functioning of key registers, such as PESEL, the civil status register and the Passport Document Register. As emphasized in the justification for the project, the new solutions are intended to enable some official matters to be handled electronically, which will significantly reduce the need for personal visits to offices.
Pursuant to applicable regulations, a divorced person who changed his surname as a result of marriage, may return to the pre-marriage surname within one year from the date the divorce decree becomes final. For this purpose, a declaration must be submitted to the head of the registry office or the consul.

In 2023, 11,000 people took advantage of this opportunity. people, and in 2024 this number increased to 11.7 thousand. Now, thanks to the new e-service, such a declaration can be submitted online.
The bill also provides for other changes, including: enabling deregistration to be performed by any municipal authority, and not, as currently, only by the office competent for the current place of residence.
Restrictions on issuing a PESEL number. Another key change
Another key proposal concerns the restriction of issuing PESEL numbers to foreigners. This number would be granted only in justified cases, which will eliminate situations in which the basis for assigning it is only the need to confirm a trusted profile. Additionally, the PESEL register is to collect information on the type of identity documents and citizenship of foreigners.
The amendment also provides for facilitations for courts, which, thanks to the decision of the Minister of Digital Affairs, will be able to access data from registers such as PESEL, the register of passport documents, the register of ID cards or the civil status register. Importantly, courts will not have to request access to this data in each case separately.

The draft law, which aims to digitize and simplify administrative procedures, is still at the public consultation stage. As the authors of the project emphasize, the changes are aimed at improving the comfort of citizens and increasing the efficiency of the Polish administration.
