According to the indictment, the first fire took place on the night of December 9/10, 2017, when the defendant allegedly used flammable objects to destroy several outbuildings and the roof of a house. Estimated damage: 1,000,000 lei.
The second, similar act would have occurred on the night of December 27/28, 2017, when the same defendant, using diesel and matches, would have set fire to other outbuildings where animals were kept, as well as the roof of a home belonging to another injured party. Damage: approximately 350,000 lei. In both situations, the investigators noted that the actions were committed at the instigation of the mayor.
Complementary penalties and the court's explanations
Although Bratosin fully denied the charges, the court did not accept his evidence and arguments. The documents, expertise and statements of the firemen clashed, but the judges gave weight to the testimonies that pointed to the mayor as the instigator.
Based on the legal provisions, the Galati Court of Appeal imposed on the mayor, in addition to the main punishment, the prohibition to be elected or to hold positions involving the exercise of state authority for a period of 2 years. At the same time, the period spent in preventive detention, between May 9 and 17, 2018, was deducted from the sentence.
